What the Project Management Residence Contract Is

The Project Management Residence Contract is a written agreement that defines the scope, schedule, responsibilities, payment terms, and dispute resolution for project management services related to a residential property. It documents the parties involved, the work to be performed, deliverables, acceptance standards, insurance and indemnity provisions, and change-order procedures. The contract establishes when services begin and end, how payments are calculated and made, and which state law governs interpretation. Well-drafted agreements reduce ambiguity and form the basis for billing, lien rights, insurance claims, and any later enforcement action.

Why a Formal Contract Matters for Residential Projects

A clear written contract reduces disputes by allocating risk, setting expectations for performance and payment, and documenting change-management and completion criteria under enforceable state law.

Why a Formal Contract Matters for Residential Projects

Who Typically Completes This Contract

Common signers include the project manager, the homeowner or owner’s representative, and any authorized contractor or vendor representative.

  • Project managers and construction managers documenting deliverables, milestones, and oversight responsibilities in writing.
  • Homeowners or property owners agreeing to scope, budget, and acceptance criteria for renovation or remediation work.
  • General contractors or specialty subcontractors confirming role, insurance, and billing relationships with the managing party.

Each signer should confirm authority to bind their organization and verify that names and titles match supporting documents before signing.

Primary Signatory Profiles

Project Manager

An individual or firm hired to coordinate residential work, schedule subcontractors, and verify completion. The project manager typically accepts responsibility for project oversight, issues change orders within delegated limits, and provides status reports to the owner; the contract should specify their decision authority and limits.

Homeowner / Owner Representative

The homeowner or authorized representative funds the project and approves scope and change orders. The homeowner’s signature confirms payment obligations, acceptance criteria, and permission for access; mismatched names or unauthorized signers can invalidate enforcement or delay payments.

Key Contract Sections to Include

A comprehensive Project Management Residence Contract contains discrete sections that assign responsibility, define work, and set financial and legal terms to reduce ambiguity and support enforceability.

Scope of Work

Describe specific project tasks, deliverables, excluded work, milestones, and acceptance tests so the parties share a common definition of completion and inspection criteria.

Schedule and Milestones

List start and completion dates, intermediate milestones, and penalties or remedies for delays; include procedures for extensions due to weather or change orders.

Payment and Fees

Specify total compensation, invoicing frequency, retainers or deposits, accepted payment methods, late fees, and conditions triggering progress or final payments.

Change Orders

Define how modifications are proposed, approved, and priced; require written, signed change orders before work proceeds to avoid disputes over scope creep.

Insurance and Liability

Require appropriate insurance coverage (general liability, workers’ comp) and specify indemnity limits and procedures for claims arising from onsite work or property damage.

Dispute Resolution

Include governing law, venue, and whether arbitration or mediation is required before litigation; this clarifies how disagreements will be resolved and where.

Frequent Preparation Errors to Avoid

  • Failing to attach the detailed statement of work, which creates ambiguity about responsibilities and billing.
  • Leaving payment terms undefined or using vague language like 'reasonable payment' that complicates collection and dispute resolution.
  • Not confirming signer authority or using informal signers, which can produce unenforceable agreements and delay remedies.
  • Neglecting to document change orders in writing and signed form, causing disputes over extra work or costs.

Verify the signer's authority for corporate or trust entities and retain evidence of delegation or resolution where applicable.
Attach Exhibits
Attach plans, schedules, insurance certificates, and detailed scope exhibits to avoid later argument about what was included.
Record Audit Trails
