RRP Rule Compliance and Safety

Service Provider certifies that all work affecting painted surfaces subject to RRP rule requirements will be performed in compliance with applicable RRP procedures, including: use of trained personnel, containment of work area, dust and debris control, worker decontamination, proper waste handling, and recordkeeping that documents compliance and training for affected employees. Service Provider will provide Client, upon request, documentation of training and procedures implemented for this project.

By checking the box, Service Provider affirms compliance with RRP procedures and agrees to indemnify and defend Client for claims arising from Service Provider's noncompliance with RRP obligations in performing the work described herein.

Confidentiality

Each party agrees that all non-public information obtained in connection with the project shall be treated as confidential and used solely for performance under this Statement. Confidential information may not be disclosed to third parties except as required by law or with prior written consent of the disclosing party. Obligations survive termination for a period of three years.

Liability, Insurance & Remedies

Service Provider shall maintain insurance consistent with industry standards and provide certificates upon request. Except for willful misconduct, each party's total liability for claims arising out of this Statement shall be limited to direct damages not exceeding the total contract price. The foregoing limitation does not apply to indemnification obligations arising from RRP noncompliance or bodily injury.

Governing Law & Dispute Resolution

This Statement shall be governed by the laws of the jurisdiction indicated below without regard to conflict-of-law principles. The parties agree to attempt good-faith negotiation prior to initiating any litigation; remedies at law shall be supplemented by equitable relief where appropriate to enforce obligations under this Statement.

No amendment to this Statement shall be effective unless in writing and signed by both parties. If any provision is held invalid, remaining provisions shall remain in full force. This Statement constitutes the entire agreement between the parties regarding the subject matter herein.
