1. Effect of Instruction: This Site Instruction is issued pursuant to the Contract. Where this instruction results in changes to the Contract Sum or Time, the Contractor shall submit a written change order proposal in accordance with the Contract within the response period specified above. No work will be treated as a change to the Contract unless and until a formal change order is executed by the parties.

2. Compliance: Contractor shall execute the work in compliance with the Contract Documents, applicable laws, regulations, and site-specific safety requirements. Contractor remains responsible for means, methods, sequencing and safety notwithstanding issuance of this instruction.

3. Indemnity and Liability: Contractor shall indemnify and hold harmless the Client for losses arising from Contractor performance of this instruction to the extent caused by Contractor's negligence, willful misconduct, or failure to comply with contractual obligations. Nothing in this instruction shall waive or modify insurance or indemnity provisions of the Contract except by written amendment.

4. Confidentiality: Information provided in connection with this instruction that is designated confidential shall be kept confidential by the receiving party and used only for performance of the instruction, subject to the confidentiality terms of the Contract.

5. Governing Law: This Site Instruction and any disputes arising from it shall be governed by the governing law specified in the Contract between the parties.

6. Reservation of Rights: Issuance of this instruction shall not prejudice any party's rights under the Contract, including entitlement to time, money or equitable adjustment, except as expressly set forth in a fully executed change order.
