What a Prop 65 Notice Is and when it applies

A Prop 65 Notice is a consumer-facing disclosure required under California's Safe Drinking Water and Toxic Enforcement Act of 1986 (commonly called Proposition 65, Cal. Health & Safety Code §25249.5 et seq.) when a business knowingly exposes Californians to chemicals listed under the statute. Notices are used for consumer products, workplace exposures, and environmental releases that contain or generate one or more listed chemicals above the state-established No Significant Risk Levels (NSRLs) or Maximum Allowable Dose Levels (MADLs). The notice informs individuals of the chemical name(s) and a clear statement that the product or activity can expose them to listed chemical(s).

Why a clear Prop 65 Notice matters

A compliant Prop 65 Notice reduces legal exposure, supports transparent consumer information, and helps businesses demonstrate good-faith compliance with California law.

Why a clear Prop 65 Notice matters

Who typically prepares and receives Prop 65 Notices

Businesses, product manufacturers, distributors, retailers, and property owners operating in or shipping to California commonly prepare Prop 65 Notices. Consumers, employees, contractors, and regulators are the primary recipients.

  • Manufacturers and brand owners who place products into the California market must assess chemical content and provide notices when thresholds are exceeded.
  • Retailers and distributors often rely on upstream supplier information but may be required to post notices at point-of-sale or on packaging where applicable.
  • Property owners and employers must post workplace or site notices for exposures that occur at premises or during ongoing operations.

Determining responsibility depends on supply-chain role, distribution method, and where exposure occurs; many organizations use legal counsel and testing labs to confirm notice obligations.

Core elements to include in a professional Prop 65 Notice

A complete Prop 65 Notice combines clear language with specific factual elements so recipients can understand the exposure and take action if desired.

Clear warning

A short statement indicating the product or location can expose individuals to listed chemical(s).

Chemical identification

Name the chemical(s) known to cause the exposure, using the listing name whenever feasible.

Exposure route

Indicate how exposure occurs (e.g., ingestion, inhalation, skin contact) so recipients can assess risk.

Source or product

Identify the product type, brand, or specific activity/location associated with the exposure.

Date or version

Include an issuance or revision date to show when the notice was prepared or updated.

Contact information

Provide a responsible party or corporate contact for questions and further information.

Required details commonly captured on a Prop 65 Notice

Warning statement: Clear, affirmative warning
Chemical name: Listed chemical(s) identified
Exposure route: Inhalation | Ingestion | Skin contact
Product or location: Brand or premises named
Date: MM/DD/YYYY format recommended
Contact: Phone or email for questions

Step-by-step: preparing and issuing a Prop 65 Notice

Follow this sequence to evaluate exposure, prepare the notice, and distribute it consistently across affected products or sites.

  • 01
Identify chemicals: Review product materials, supplier declarations, and lab tests to detect listed chemicals.
  • 02
Assess thresholds: Compare exposure estimates to NSRLs or MADLs or consult counsel on safe harbor options.
  • 03
Draft notice: Assemble required elements: warning, chemical names, exposure route, product/location, date, contact.
  • 04
Distribute: Apply label, online disclosure, point-of-sale posting, or site signage depending on the context.

How to configure an online Prop 65 notice workflow

Set up a repeatable digital workflow to apply consistent notice language and capture distribution records.

Field Configuration
Warning template Reusable text block applied to products or pages
Chemical dropdown Standardized chemical names for consistency
Effective date field Auto-fill current date or allow manual override
Audit logging Record who published notice and when

How digital issuance and recordkeeping typically works

Digital workflows simplify distribution, preserve evidence of publication, and reduce manual errors when issuing Prop 65 Notices.

  • Create notice: Prepare standardized text and select affected SKUs or locations.
  • Apply channels: Choose label printing, website banner, POS signage, or email distribution.
  • Publish: Push notice live and timestamp the publication artifact.
  • Store evidence: Archive notice versions, distribution logs, and supporting chemical data.

Digital delivery and eSubmission considerations

When issuing Prop 65 Notices electronically, ensure recipients can access the notice, that the same information is presented as in any physical notice, and that distribution is logged.

  • Accessibility: Use clear fonts, readable contrast, and mobile-responsive layouts; include printable versions.
  • Audit trail: Capture timestamp, publishing account, and target list for potential enforcement inquiries.
  • Authentication: Where recipient-specific delivery matters, use email verification or SMS code to confirm receipt.

Retain distribution records in secure systems and export immutable copies for regulatory responses or litigation defensibility.

Common mistakes to avoid when preparing a Prop 65 Notice

  • Using vague language that omits the listed chemical name or exposure route, which weakens transparency and may invite challenges.
  • Failing to align the notice format across channels (labels, website, signage), creating inconsistent disclosures.
  • Neglecting to document testing data, supplier declarations, or exposure assessments used to justify whether a notice is required.
  • Assuming federal preemption; Prop 65 is a California statute and applies to exposures affecting California residents.

Penalties and legal risks for noncompliant notices

Civil penalties: Up to $2,500 per day per violation under Cal. Health & Safety Code §25249.7
Private enforcement: Private parties may file citizen suits and seek penalties plus injunctive relief
Deficiency exposure: Incomplete notices can trigger corrective notice orders or injunctive remedies
Reputational risk: Consumer trust and retailer relationships may be harmed by repeated notices
Cost of defense: Attorney fees and remediation expenses can be substantial
Product disruption: Products may be removed from sale pending remediation or relabeling

Timing considerations and practical deadlines

There is no single statutorily prescribed public filing deadline for Prop 65 pre-sale notices, but timing is important for remediation and litigation risk management.

Immediate posting:

Post notices at point-of-sale or on product pages as soon as an exposure requiring a warning is identified

Versioning:

Record the date of each notice version in MM/DD/YYYY format for audit purposes

Re-testing cadence:

Reassess product formulations or processes when suppliers change or annually for high-risk items

Responding to claims:

Act promptly on 60-day pre-litigation notices often used by private enforcers

Remediation window:

Allow time for reformulation, relabeling, or supplier changes before enforcement escalates

Track these sequential milestones to maintain compliance and create an evidentiary trail for enforcement or internal audits.
