Insurance, Liability and Indemnity

Insurance: Lessee shall maintain liability insurance covering the leased equipment, naming Lessor as an additional insured, in the minimum amount of $ per occurrence and shall provide evidence of such insurance upon request.

Indemnity: Lessee shall indemnify, defend and hold harmless Lessor from and against all claims, loss, damage, liability and expense (including reasonable attorneys' fees) arising out of Lessee's use, negligence, or breach of this Agreement, except to the extent caused by Lessor's gross negligence or willful misconduct.

Default and Remedies

Default: The following events constitute default: failure to pay amounts when due and failure to perform material obligations under this Agreement after written notice and a day cure period. Upon default Lessor may terminate this Agreement, recover unpaid fees and remove equipment in accordance with applicable law.

Remedies: The rights and remedies provided are cumulative and in addition to any other rights or remedies available at law or in equity.

Removal and Restoration

Upon expiration or termination, Lessor may remove the tank and related equipment within days. Lessee shall permit removal and shall restore the site to substantially the condition existing prior to installation, except for ordinary wear and tear.

Governing Law and Miscellaneous

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of law principles.
