What the Property Condition Removal Form Is

The Property Condition Removal Form documents a buyer's acknowledgement that specified property condition contingencies have been satisfied or waived under a purchase contract. It records which inspections or repairs were reviewed, the effective date of removal, and any remaining obligations tied to disclosures or agreed repairs.

Why using a clear removal form matters

A formal removal form creates a written record of a buyer's decision, reduces ambiguity about remaining obligations, and helps protect parties if a later dispute arises over disclosed defects or repair expectations.

Why using a clear removal form matters

Typical users and where the form fits in a transaction

Keep copies with the purchase agreement and closing package to ensure clear chain-of-record custody and to support title and escrow processes.

  • Buyers who accepted condition after inspections and choose to proceed without further contingencies.
  • Sellers seeking documented confirmation that contingencies were waived or satisfied prior to closing.
  • Escrow or title officers verifying that contractual contingencies are cleared before funding or recording.

Step-by-step: completing the Property Condition Removal Form

Follow a consistent order: identify parties, reference contract, state removed contingencies, attach evidence, and obtain signatures.

  • 01
Identify Parties: Enter buyer and seller names exactly.
  • 02
Reference Contract: Cite purchase agreement date and section.
  • 03
Record Removal: Specify which contingencies are removed.
  • 04
Sign and Date: All signatories must sign and date the form.

Where the completed form is routed next

After signatures, distribute the executed form to parties who rely on contingency status for closing and title clearance.

  • Escrow Agent: Receives form to confirm release conditions before funding.
  • Title Company: Uses the form to clear condition-related exceptions.
  • Listing Broker: Keeps a transaction file copy for seller records.
  • Lender: May require the form to proceed with final loan approval.

Platform and format considerations for e-submission

Ensure the vendor retains a tamper-evident audit trail and, for healthcare or PHI attachments, a signed BAA. Store final PDFs in escrow and title records for continuity and compliance.

  • Supported Formats: PDF, DOCX export options
  • Authentication: Email link, SMS code, KBA
  • Integrations: Salesforce, NetSuite, Microsoft 365

Essential sections every professional removal form should include

A thorough form balances clarity for parties and evidence for closing. Include identification, contract linkage, contingency details, effective date, representations, and signature authentication.

Party Identification

Full legal names and contact details for buyer(s) and seller(s), including company or trust names when applicable, to prevent ambiguity in signatory authority.

Property Description

Complete street address and legal description or parcel number when available, ensuring title and escrow officers can match the form to the recorded property.

Contract Reference

Cite the purchase agreement date and specific contingency clause to link the removal clearly to existing contractual obligations and timelines.

Contingency Details

Describe precisely which contingencies are removed (inspection, financing, appraisal), and attach inspection reports or lender waivers when required.

Effective Date

A clear MM/DD/YYYY effective date establishes when obligations change and can affect deadlines tied to closing, financing, and recording.

Signatures and Notarization

Signature blocks for all parties, electronic or ink signatures, and notarization fields when required by state law or escrow instructions.

Security and compliance features to include

Encryption: TLS 1.2/1.3; AES-256
Audit Trail: Timestamps and IP addresses
HIPAA BAA: BAA required for PHI
Access Controls: Role-based signer permissions
Retention Policy: Immutable signed copies
Notary Recordings: Audio-video when RON used

Key risks and consequences of incorrect forms

Contract Voidance: May create enforceability disputes
Contingency Failure: Buyer protections may be lost
Title Complications: Unclear removals can delay closing
Delay Costs: Additional holding or financing fees
Record Rejection: Escrow or lender rejection possible
Legal Fees: Potential litigation or cure costs

Common preparation errors to avoid

  • Omitting the contract date or clause reference creates ambiguity about which contingency is being removed and can lead to conflicting interpretations.
  • Entering informal party names or nicknames instead of legal names can delay notarization, title clearance, or lender acceptance of the form.
  • Failing to attach inspection reports or lender waivers removes critical evidence needed to confirm that the contingency was satisfied per the agreement.
  • Using an incorrect effective date or unsigned pages can render the removal ineffective for closing, requiring re-execution and possible schedule shifts.

Typical timelines and processing expectations

Deadlines depend on the purchase contract; review the stated contingency removal date and any contract addenda before completing the form.

Contingency Removal Deadline:

Follow the contract-specified date; commonly ranges from 3 to 14 days

Inspection Report Attachment:

Attach within the period specified by the contract or inspection contingency

Lender Requirements:

Allow extra time for lender review when financing contingencies are involved

Escrow Processing:

Escrow may require 1–3 business days to update files

Recording and Closing:

Ensure removal is processed before funding and any recording steps

Real-world examples of form use in property transactions

Two brief examples show how practitioners document contingency removal in practice.

Martin Properties (Broker)

A regional brokerage used a removal form to record buyer acceptance after repairs were completed

  • The broker attached the inspection report and repair invoice
  • The documented removal allowed escrow to fund on schedule and prevented a later dispute over repair scope.

Optica Ventures (Investor)

An investor waived minor inspection contingencies in a quick-markets purchase

  • The form referenced the contract clause and effective date
  • The clear record supported a smooth closing and provided evidence for downstream title checks.

Practical tips for accurate and efficient completion

Follow consistent processes and preserve evidence to avoid delays and disputes at closing.

Use exact legal names and references
Always enter party names and contract citations verbatim. Cross-check names against the purchase agreement and title documents to prevent mismatches that can delay notarization or title clearance.
Attach supporting evidence
Include inspection reports, repair invoices, lender waivers, or contractor certifications when removing condition contingencies. Attachments provide objective proof and reduce later disagreements about whether conditions were satisfied.
Preserve audit trail for e-signatures
When signing electronically, ensure the platform captures timestamps, IP addresses, and signer authentication method. Maintain exported signed PDFs and the certificate of completion for escrow and title files.
Verify local notarization requirements
Check state or county rules for notarization or witness requirements prior to execution. For remote notarization, confirm the notary's compliance with state RON rules and retention obligations.
