What the Property Contingency Removal Form Is

The Property Contingency Removal Form is a contractual notice used in real estate transactions to formally remove one or more contingencies from a purchase contract. Common contingencies include inspection, financing, appraisal, title review, and sale-of-home conditions. Filing this form signals the buyer’s decision to proceed without the named contingency, or to remove it for a specific property, and it typically requires the buyer’s signature and date. Because removal changes the parties’ obligations and risk allocation before closing, accurate completion and timely delivery are essential to maintain enforceability and avoid disputes.

Why a Clear Contingency Removal Notice Matters

A precise Property Contingency Removal Form reduces ambiguity about which protections remain and which are waived, clarifies the timeline toward closing, and preserves evidence of mutual intent. Properly executed removal can prevent misunderstandings with lenders, title companies, and sellers and reduces the risk of post-closing disputes over contract compliance.

Why a Clear Contingency Removal Notice Matters

Who Typically Prepares and Signs This Form

Several parties interact with contingency removal documents during a residential or commercial sale; roles vary by transaction complexity and local custom.

  • Buyers or buyer’s agent — Prepares and signs removal when the buyer elects to waive or satisfy a contingency; coordinates with lender if financing is involved.
  • Listing agent or seller — Reviews removal language to confirm acceptance and updates the contract timeline and closing coordination.
  • Lender and title company — Receives copies to verify remaining conditions for underwriting and title clearance prior to closing.

Each signer should understand the legal and financial consequences of removal; parties often consult counsel or broker guidance before submitting the form.

Essential Elements of a Professional Contingency Removal Form

A robust form is concise, identifies the contract and property precisely, names the contingency being removed, records dates, and captures clear signatures and witness or notary blocks where required.

Contract ID

Reference the original purchase agreement date, contract number, and the parties’ full legal names so the removal ties unambiguously to an existing contract.

Property Details

Provide the full property address, legal description or parcel number to avoid ambiguity if multiple properties are under contract between the same parties.

Contingency Specified

Identify the precise contingency removed (e.g., 'inspection contingency dated MM/DD/YYYY') and whether removal is full or limited to specific items.

Effective Date

State the effective removal date using MM/DD/YYYY format; this date determines when obligations shift and triggers any related deadlines.

Signatures

Include signature, printed name, title (if applicable), and date for each party; designate whether initials are acceptable or full signatures required.

Notary/Witness

Add notarization or witness blocks where state law or contract requires them; specify RON allowance if electronic notarization will be used.

Required Information to Include on the Form

Buyer Name: Full legal name
Seller Name: Full legal name
Property Address: Street, city, state, ZIP
Contract Date: MM/DD/YYYY
Contingency Type: Inspection | Financing | Appraisal
Signature Date: MM/DD/YYYY

Step-by-Step: Completing and Submitting the Form

Follow a short sequence to ensure removal is effective and distributed to required parties without delay.

  • 01
Locate Contract: Open the original purchase agreement and note contract identifier.
  • 02
Fill Form: Complete buyer, seller, property, contingency, and dates accurately.
  • 03
Sign and Authenticate: Obtain required signatures, notarization, or electronic authentication.
  • 04
Distribute Copies: Send to seller, agents, lender, and title company and retain a copy.

Digital Workflow Settings for Online Completion

Configure the digital workflow so signers receive clear instructions, required fields are enforced, and copies route to all stakeholders automatically.

Field Configuration
Signature Type Email link or in-person; enable e-signature audit trail
Authentication Email + SMS code or ID verification for higher assurance
Routing Set automatic copies to lender, title, and both agents
Conditional Fields Show notary block only when state or contract requires it

Where to Send the Completed Form

After execution, the form should be shared with every party whose actions depend on the removal so underwriting and title clearance proceed without interruption.

  • Seller or Listing Agent: Provides acceptance confirmation and updates seller records.
  • Buyer’s Lender: Verifies any remaining underwriting conditions are satisfied.
  • Title Company: Updates title clearance checklist and continues closing prep.
  • Both Brokers: File the executed form in transaction management systems.

Digital Signing and Integration Considerations

Use an e-signature platform that supports required authentication, audit trails, and integration with transaction management tools.

  • Authentication Options: Email link, SMS code, KBA, or ID verification
  • Audit Trail: Capture IP, timestamp, and signer actions
  • Integrations: Connectors for MLS or CRM such as Salesforce, NetSuite, Box

Confirm the platform supports any contract-specified authentication and preserves a tamper-evident signed copy for distribution and retention.

Typical Timing and Deadlines to Watch

Contingency removal timing is usually defined by the purchase contract, lender underwriting schedule, and local closing deadlines; missing a deadline can alter rights to terminate or retain earnest money.

Inspection Contingency Deadline:

Remove by the contract-specified inspection period end date

Financing Contingency Deadline:

Remove after lender issues conditional or final approval

Appraisal Contingency Deadline:

Remove once appraisal meets contract value or parties agree

Title Objection Deadline:

Remove after title cure or waiver within the contract time frame

Closing Date Impact:

Removal often accelerates path to the scheduled closing date

Common Errors When Preparing a Contingency Removal

  • Leaving the contingency description vague, causing disagreement about what was actually waived or reserved
  • Using initials instead of full signatures when the contract requires a signed removal, creating acceptance disputes
  • Failing to deliver the executed removal to lender or title company, which can delay or derail closing
  • Not checking whether notarization or witnesses are required under state law or the contract

Consequences of an Incorrect or Untimely Removal

Loss of Contingency: Buyer may forfeit rights tied to the contingency
Earnest Money Risk: Potential forfeiture if termination rights are lost
Contract Breach: Damages or specific performance exposure
Lender Denial: Underwriting may be jeopardized
Title Delays: Unresolved issues can postpone closing
Recordkeeping Failure: Absence of proof complicates disputes
