What the Property Inspection Addendum Is

A Property Inspection Addendum is a contract attachment used in residential real estate transactions to record inspection results, request repairs or credits, and set buyer and seller obligations after a home inspection. It modifies the purchase agreement by specifying items found during inspection, proposed remedies, timelines for repair or credit, and acceptance or termination rights tied to inspection contingencies. The addendum is typically executed by buyer and seller or their agents and becomes part of the enforceable purchase contract once signed by all required parties.

Why a Clear Inspection Addendum Matters

A properly drafted Property Inspection Addendum clarifies expectations, reduces dispute risk, and preserves inspection contingency rights between buyer and seller.

Why a Clear Inspection Addendum Matters

Who Typically Completes the Addendum

Agents, buyers, and sellers commonly prepare or review the Property Inspection Addendum before final acceptance of inspection findings.

  • Buyers' agents prepare buyer requests and coordinate inspection responses with sellers.
  • Listing agents review seller responses and authorize repairs or credits on seller behalf.
  • Home inspectors supply factual findings but do not complete contract language for parties.

Legal counsel and closing agents may also review the document for enforceability and recording implications when necessary.

Core Parts of a Professional Inspection Addendum

A complete addendum organizes findings, remedies, deadlines, and signature blocks so parties and agents can resolve inspection issues without ambiguity.

Findings

A clear, itemized list of defects or conditions discovered during inspection, including location and severity to avoid later disputes.

Requested Remedies

Precise repair actions or dollar credits requested by the buyer, specifying whether repairs must be completed pre-closing or credit applied at closing.

Deadlines

Firm dates for seller response, completion of repairs, or buyer acceptance of seller offers to preserve contingency rights.

Allocation of Costs

Who pays for repairs, permits, or third-party reports, and whether credits reduce purchase price or appear as seller concessions.

Inspection Exceptions

Items accepted 'as-is' by buyer, or conditions excluded from seller repair obligations to limit later claims.

Signatures

Execution lines for buyer, seller, and agents with dates to make the addendum an enforceable amendment to the purchase contract.

Common Mistakes to Avoid

  • Vague language about defects or remedies that leaves interpretation open and invites post-closing disputes or demands.
  • Missing or inconsistent dates that create uncertainty about deadlines and can forfeit inspection contingency rights.
  • Failing to attach the full inspection report and photos, leaving the request unsupported and easier to contest.
  • Using initials or informal confirmations instead of full signatures and dates, which may not satisfy contract execution rules.

Risks and Consequences of an Incorrect Addendum

Contingency Loss: Buyer may lose right to terminate
Delay to Closing: Repairs or negotiations can postpone closing
Dispute Exposure: Ambiguity increases litigation risk
Repair Liability: Unclear scope can shift costs
Financing Impact: Lender may require repairs before funding
Record Errors: Incorrect addendum can affect closing docs

Real-World Examples

Examples show how practitioners use inspection addenda to close deals and manage repair obligations efficiently.

Martin Properties

A regional broker used a standardized addendum to capture inspection exceptions and credits quickly.

  • The buyer accepted a monetary credit.
  • The result: the transaction closed on schedule with documented repairs and no post-closing disputes, simplifying the broker's file retention obligations.

Optica Ventures

A property manager attached contractor estimates to the addendum to justify repair credits.

  • Seller approved partial credit.
  • This preserved the sale, reduced negotiation time, and provided clear accounting entries for closing and tax reporting purposes.

Tips for Accurate and Efficient Completion

Follow these practical tips to reduce ambiguity and speed negotiation of inspection items.

Use Clear, Specific Language
Describe defect location and condition precisely (for example, 'roof: missing shingles at southeast quadrant') to limit interpretation and speed seller responses.
Attach Supporting Evidence
Include the full inspector report, photos, or contractor estimates to substantiate repair requests and reduce back-and-forth over scope or cost.
Set Realistic Deadlines
Choose response and repair completion dates that account for contractor availability, permitting, and lender conditions to avoid needless extensions.
Document Acceptance Options
Offer clear alternatives—seller performs repairs by agreed date or provides a precise credit amount at closing—to streamline resolution.
