Primary Risks When the Letter Is Incorrect or Incomplete

Insurance Denial: Policy may exclude coverage.
Title Objection: Closing delays or re-opened title searches.
Lender Conditions: Funding holds or additional inspections.
Fraud Risk: False statements may trigger liability.
Notarization Errors: Invalid notary undermines enforceability.
Recordkeeping Failures: Loss of audit trail impacts disputes.

Common Preparation Mistakes to Avoid

  • Ambiguous language: Vague statements like 'no known pool' without defining the scope of knowledge or inspection can lead to later contested interpretations and potential liability.
  • Incorrect property identification: Omitting the legal description, APN, or full address risks applying the letter to the wrong parcel in title searches or insurance reviews.
  • Unsigned or improperly signed letters: Missing signer capacity, printed name, or notarization (where required) often invalidates the declaration or triggers re-execution.
  • Failure to retain records: Not storing executed copies and audit trails prevents proof of execution and complicates dispute resolution with insurers or lenders.
