Insurance, Indemnity and Liability

Applicant shall maintain commercial general liability and, where applicable, automobile and workers' compensation insurance covering the removal activities. Applicant shall name Owner as an additional insured for the removal operations if requested. Applicant agrees to indemnify and hold Owner harmless from claims, damages, or losses arising out of Applicant's removal activities except to the extent caused by Owner's gross negligence or willful misconduct.

Each party shall keep confidential and not disclose to third parties any non-public information disclosed in connection with this Application and any subsequent work, except where disclosure is required by law, regulation, or pursuant to a valid court order.
