Remedies, Indemnity, and Governing Law

If Seller knowingly fails to disclose material information regarding radon or a mitigation system as required by applicable law, Seller shall be liable for actual damages and any reasonable remedies available to Buyer under the purchase agreement or law. Seller agrees to indemnify and hold Buyer harmless for claims resulting from Seller's intentional or reckless nondisclosure.

This Radon Disclosure Form shall be governed by the laws of the state in which the property is located. This form, together with any attached radon reports expressly referenced, constitutes the entire radon disclosure agreement between the parties regarding the matters disclosed herein.
