What a Raffle Prize Agreement Is and when you need it

A Raffle Prize Agreement documents the transfer of a prize from an organizer to a winner, recording prize description, retail value, delivery terms, tax treatment, and any conditions tied to acceptance. Use this written agreement to create clear obligations for both parties, reduce disputes about prize delivery or substitution, and provide supporting evidence for required tax reporting and record retention. It typically accompanies winner notification, certificate issuance, or a claim form and may be used by charities, schools, retailers, and event promoters that run raffles under state laws and permitting requirements.

Why having a written Raffle Prize Agreement matters

A Raffle Prize Agreement fixes key terms—who receives the prize, its fair market value, delivery deadlines, tax obligations, and any liability releases—so organizers and winners have identical expectations and regulators can verify compliance.

Why having a written Raffle Prize Agreement matters

Who commonly uses a Raffle Prize Agreement

Use the agreement whenever a prize has monetary value, requires documentation for tax reporting, or the organizer needs written consent from the winner for publicity, delivery, or substitution terms.

  • Nonprofit organizers documenting licensed fundraising raffles and tracking prize distribution for audit and state reporting.
  • Schools and booster clubs that run ticketed raffles and must provide receipts and prize acknowledgements to winners.
  • Retail or promotional teams awarding merchandise or services as prizes, needing evidence for inventory and tax purposes.

Step-by-step: Completing and executing the Raffle Prize Agreement

Follow these sequential steps to prepare the agreement, confirm the winner, and document delivery.

  • 01
Prepare document: Draft prize details, terms, and contact information before winner notification.
  • 02
Notify winner: Confirm identity and acceptance in writing to create clear acceptance evidence.
  • 03
Execute agreement: Have both organizer and winner sign the agreement; record date and method of signature.
  • 04
Deliver prize: Arrange delivery per the agreement and capture proof of receipt.

Typical digital workflow settings for handling the agreement

Set up the agreement in an e-signature platform to speed execution and preserve an audit trail for compliance and tax records.

Field Configuration
Signature Field Required for both organizer and winner
Date Field Auto-fill on signer completion
Attachments Enable upload for ID or proof of prize condition
Audit Settings Capture IP, timestamp, and authentication method

From draft to delivery: the agreement lifecycle

This condensed flow shows how the agreement moves from preparation to final record.

  • Draft and review: Create terms and verify prize details for accuracy.
  • Send to winner: Deliver electronically or in person; request signature and ID, if required.
  • Confirm and deliver: Record acceptance and arrange prize transfer within stated timeframe.
  • Retain records: Store executed agreement and evidence per retention rules.

Key sections to include in a professional Raffle Prize Agreement

A complete agreement reduces ambiguity and protects both parties; include these essential sections for clarity and enforceability.

Prize identification

Clear, specific description of the prize, including model, quantity, and any serial numbers or distinguishing features to avoid later disputes.

Value and taxes

Statement of retail or fair market value plus party responsibility for tax reporting and any required withholding.

Acceptance terms

How the winner accepts the prize, deadlines to claim, and consequences for failure to accept within the specified window.

Delivery and transfer

Method, timeline, shipping responsibility, and risk-of-loss allocation until the winner has received the prize.

Representations and warranties

Short warranties about the organizer's authority to award the prize and any conditions about the prize's condition or functionality.

Liability and publicity

Limitations of liability, indemnification language, and any consent for use of winner's name or likeness for promotional purposes.

Supporting clauses and exhibits to attach

Add attachments and clauses that clarify operational details and legal rights related to the prize award.

Exhibit: Delivery checklist

Include a delivery checklist or condition report confirming the prize's inventory, condition on transfer, and any serial numbers for recordkeeping.

Exhibit: Tax guidance

Attach a short notice to winners explaining federal tax reporting expectations and forms that may be issued for prizes meeting IRS thresholds.

Substitution policy

Detail permissible substitutions, valuation method for substitute prizes, and winner consent requirements if substitution is allowed.

Privacy notice

State how winner personal data will be used, whether it will be shared with sponsors, and retention practices for contact and tax information.

Practical tips for accurate and efficient completion

Follow these practical rules to reduce risk and administrative overhead when awarding raffle prizes.

Record the retail value precisely
Document the fair market or retail value in U.S. dollars; inconsistent valuation can create tax reporting errors and disputes with winners.
Collect and verify ID
Confirm the winner's identity using government-issued ID before finalizing the award to prevent fraud and ensure the name matches reporting documents.
Use a preserved audit trail
When signing electronically, capture signer authentication, IP address, timestamp, and signed PDF to support intent and attribution under ESIGN/UETA.
Coordinate tax and accounting
Work with accounting to determine 1099 filing obligations and withholding requirements based on prize value and organizer type.

Common mistakes to avoid when preparing the agreement

  • Failing to state the prize value clearly leads to tax reporting inconsistencies and potential IRS notice delays.
  • Not verifying winner identity before release can result in fraud, disputed deliveries, or incorrect 1099 filings.
  • Omitting delivery terms creates confusion about who bears shipping costs or risk if the prize is lost in transit.
  • Using vague substitution language allows disputes if the organizer replaces the prize with lower-value items.

Penalties and legal risks from an incorrect or incomplete agreement

Tax reporting: Late or missing 1099s risk IRC §6721 penalties
State raffle violations: Fines or permit revocation for noncompliance
Contract disputes: Winner claims or breach litigation
Withholding errors: Uncollected tax obligations against payer
Privacy breach: Unauthorized disclosure of winner data
Notarization failure: Invalid acknowledgements where required

Time-sensitive dates to track when awarding prizes

Track calendar items related to award notification, delivery, and tax filings to avoid regulatory or reporting penalties.

Winner claim deadline:

Specify a claim window (e.g., 30–90 days) for winners to accept prizes

Delivery timeframe:

Set a delivery deadline (e.g., within 30 days of acceptance)

1099 reporting deadline:

Issue required information returns per IRS deadlines (generally Jan 31 for many forms)

Record retention start:

Retention begins on date of award or executed agreement

Dispute period:

Set an administrative window for resolving delivery or compliance disputes
