Landlord Responsibility: Landlord will maintain common-area amenities and major building systems in a reasonable state of repair. Landlord is responsible for repairs to appliances, HVAC, plumbing and electrical systems unless damage is caused by Tenant negligence or misuse.

Access for Repairs: Tenant shall permit Landlord or its agents reasonable access to perform maintenance and repairs to amenities. Landlord will provide notice as required under applicable law except in emergency situations.

Representations, Liability & Remedies

Landlord represents that the amenities listed as Provided were in the condition described at the time this form was executed. Tenant accepts the amenities in their described condition, subject to the repair obligations set forth above. Landlord does not guarantee uninterrupted use of any amenity and shall not be liable for temporary interruptions caused by repairs, maintenance, or circumstances beyond Landlord's reasonable control, except where such interruption is the result of Landlord's gross negligence or willful misconduct.

Indemnity: Tenant shall indemnify and hold Landlord harmless from claims, damages, or costs arising from Tenant's improper use or negligent maintenance of any amenity provided to Tenant under this form. Landlord shall indemnify Tenant for damages resulting from Landlord's breach of repair obligations or negligent acts.

Default and Remedies: Breach of the maintenance obligations or misuse of amenities constitutes a default under the primary lease and entitles the non-breaching party to pursue remedies available at law or equity, including termination of the lease, repair and chargeback, or injunctive relief.

Governing Law; Entire Agreement

This Amenities Form shall be governed by the laws of the state in which the Property is located. This form, together with the primary lease or purchase agreement to which it is attached, constitutes the entire agreement between the parties relating to amenities and supersedes prior oral or written statements.
