What the Real Estate AST23 Template Is and When It Applies

The Real Estate AST23 Template is a standardized document used to capture transaction-specific terms, party details, property identifiers, and procedural milestones for real estate matters governed by the AST23 workflow. It collects critical data such as legal names, property address and parcel number, contract dates, consideration, contingency deadlines, and signature blocks for all parties. The template is designed to be adaptable to purchase, lease, assignment, or disclosure contexts and to support electronic completion and secure eSigning where permitted by federal and state law.

Why this Template Matters for Real Estate Transactions

Using the Real Estate AST23 Template centralizes essential transaction terms, reduces drafting variation, and supports consistent recordkeeping for closings and recordings. It is particularly useful where speed, clear timelines, and accurate property identification are required.

Why this Template Matters for Real Estate Transactions

Who Commonly Prepares or Signs an AST23 Document

The template supports role-based completion and handoffs between parties, reducing omissions and clarifying who must sign or approve each section.

  • Listing and selling agents who prepare transaction terms and disclosures prior to offers being accepted.
  • Title officers and closing attorneys who verify property identifiers, chain of title items, and recording details.
  • Borrowers, sellers, and authorized corporate signatories who provide legal names, tax IDs, and executed signatures.

Core Sections to Include in a Professional AST23 Template

A thorough AST23 template groups related fields into clear sections so reviewers can verify legal identity, property details, financial terms, contingencies, and signature authority without cross-referencing multiple documents.

Party Details

Full legal names, entity type, email, phone, and physical address for each party; include TIN when required for tax reporting or backup withholding.

Property Data

Street address, legal description, county, parcel/APN, and any recorded encumbrances or easements that materially affect conveyance.

Transaction Terms

Purchase price or rent, earnest money, payment schedule, prorations, and any seller credits or concessions tied to closing conditions.

Contingencies

Inspection, financing, appraisal, title cure periods, and explicit dates for cure or termination rights and notice mechanics.

Execution Blocks

Signature lines for each party with printed name, title (if applicable), date, and notary or witness fields where state law demands them.

Recording Instructions

Designated recording party, intended county recorder office, and any special indexing or document cover sheet requirements.

Typical Digital Workflow Settings for AST23 eCompletion

Configure familiar workflow settings to ensure consistent routing, signer authentication, and template reuse across transactions.

Field Configuration
Signature Type Electronic signature field with automatic timestamp and audit trail.
Authentication Email plus SMS code or knowledge-based authentication for high-assurance signers.
Template Locking Lock key fields to prevent accidental edits after party approval.
Bulk Send Enable bulk send for uniform disclosures to multiple recipients when appropriate.

Where to Send or File the Completed AST23 Template

Routing depends on transaction role and whether recording or lender review is required; follow designated responsibilities to avoid delays.

  • Title Company: Submit completed package to the title officer for final review and closing coordination.
  • Lender Closing: Provide executed copies to the lender for funding conditions and payoff calculations.
  • County Recorder: Record deeds and instruments with the county recorder office specified in recording instructions.
  • Retained Records: Store final executed PDF and audit trail in the transaction folder for retention and compliance.

Digital Signing and Integration Considerations

Align platform settings with your closing checklist and title provider requirements to preserve evidentiary value and chain of custody.

  • Authentication Options: Email, SMS code, KBA, or SSO depending on required assurance.
  • File Formats: Support for PDF and DOCX is essential for recording and archival.
  • Integrations: Common integrations include Salesforce, NetSuite, Google Workspace, and Microsoft 365.

Key Dates and Deadlines to Track in the AST23 Workflow

Document all date-driven milestones clearly so parties and title can act without miscommunication or missed cure windows.

Effective Date Entry:

Date the agreement becomes enforceable and starts contingency timing.

Inspection Period End:

Financing Approval Date:

Deadline for loan commitment or buyer termination for financing failure.

Closing Date:

Scheduled date for funding, deed transfer, and possession transfer.

Recording Deadline:

Common Preparation Errors to Avoid

  • Inconsistent names between the signature block and recorded title records, which can trigger recording rejections or require corrective deeds.
  • Omitting the precise legal description or parcel/APN, leading to ambiguity in the instrument and potential title challenges.
  • Leaving contingency dates vague or unspecified, creating disputes about deadline calculation and termination rights.
  • Failing to confirm notarization or witness requirements for the relevant recording jurisdiction before signing.

Consequences of Errors or Incomplete AST23 Documents

Recording Rejection: Document may be refused by recorder.
Title Defect: Unclear conveyance can create disputes.
Contract Voidance: Execution errors may impair enforceability.
Delay Costs: Missed deadlines increase carrying costs.
Tax Exposure: Incorrect TINs may trigger backup withholding.
