REAL ESTATE BACK PATIO ADDENDUM

This Back Patio Improvement Addendum (Addendum) is made between the undersigned parties and amends the Purchase Agreement or Lease Agreement dated for the Property identified below. The terms below govern the design, construction, inspection, completion, and transfer of the back patio improvements described herein.

Parties

Property Identification

Scope of Work

The Seller agrees to design and construct the back patio improvements described below in a good and workmanlike manner and in compliance with applicable building codes, permits, and zoning. The improvements shall include, at minimum, the elements listed in the Scope of Work and any attachments incorporated by reference.

Financial Terms

The following financial provisions govern payment for the back patio improvements. All amounts are in U.S. dollars unless otherwise stated.

Schedule

Time is of the essence for completion of the back patio improvements. The schedule below controls unless the parties execute a written extension.

Permits, Compliance, and Inspections

The responsible party listed below shall obtain all required permits and approvals, arrange inspections, and pay related fees. All work must comply with applicable codes and ordinances. No covering or concealment of work shall occur prior to inspection and acceptance by required authorities.

Warranties, Liens, and Insurance

Contractor warranties, lien releases, and insurance requirements protect parties and the property. The performing party shall ensure that all contractor and subcontractor work is accompanied by unconditional final lien releases prior to release of any escrow holdback.

Disclosures

The parties must disclose known conditions affecting the proposed improvements. Mark the applicable boxes to acknowledge existence or absence of the listed conditions.

Maintenance, Access, and Utilities

After completion and acceptance, responsibility for routine maintenance, repairs, and utility costs associated with the patio shall be allocated as set forth below.

Default, Remedies, and Escrow

If improvements are not completed by the Completion Date, the non-breaching party may elect remedies including specific performance, monetary damages, extension of closing, permit of escrow holdback, or termination of the underlying transaction as set forth in the controlling agreement. Liquidated damages, if any, shall be limited to the amount stated below.

Indemnity and Liability

Each party agrees to indemnify, defend, and hold the other harmless from claims, liabilities, losses, and expenses arising from that party's negligence, wilful misconduct, or failure to obtain required permits for the work. Contractor claims shall be satisfied by the performing party and final unconditional lien releases shall be provided prior to release of funds.

Governing Law and Entire Agreement

This Addendum shall be governed by the laws of the state in which the Property is located. This Addendum constitutes the entire agreement between the parties with respect to the back patio improvements and supersedes all prior negotiations and representations. Any modification shall be in writing and signed by both parties.

The parties acknowledge that they have read this Addendum in its entirety, understand its terms, and agree that it is binding upon their respective heirs, successors, and assigns.

What the Real Estate Back Patio document covers

The Real Estate Back Patio document records details about a property's rear patio area for sale, lease, or renovation purposes. It typically documents dimensions, materials, improvements, access points, existing encumbrances, and any recent work or permits. The form may be used as a standalone addendum to a purchase agreement, a lease exhibit, or a contractor scope of work; it creates a written record that helps buyers, tenants, contractors, and lenders understand the patio's condition and contractual commitments tied to it. Accurate completion supports clear allocation of repair, maintenance, and disclosure responsibilities among parties.

Why a clear Back Patio record matters

A properly prepared Back Patio document reduces disputes about condition, scope, and liability by creating a precise, dated record that can be relied on by buyers, tenants, contractors, and insurers.

Why a clear Back Patio record matters

Who typically prepares and signs this form

Each party relies on the document for different outcomes — disclosure compliance, repair obligations, or payment milestones — so completeness matters.

  • Listing agents and sellers who must disclose exterior improvements or defects to prospective buyers.
  • Buyers and tenant representatives who document acceptance criteria or request repairs before closing or move-in.
  • Contractors and property managers who record scope, materials, and acceptance for work orders.

  • 03

  • 04
