What a Real Estate Buyer Agent Agreement Is

A Real Estate Buyer Agent agreement is a written contract that defines the working relationship between a prospective property buyer and the buyer's licensed real estate agent or brokerage. It sets the agent's duties, scope of services, exclusive or non-exclusive representation, commission terms, time period, and any contingencies. The agreement documents consent, clarifies expected deliverables during property search and offer negotiation, and preserves evidence of the parties’ intentions. Electronic execution is generally enforceable under the ESIGN Act (15 U.S.C. ch. 96) and applicable state law (UETA or state ESRA), subject to industry or statutory exceptions.

Why a Buyer Agent Agreement Matters for Buyers and Agents

The agreement reduces misunderstandings by documenting roles, commission, and timelines; it protects fiduciary duties, supports commission claims, and speeds transaction workflows by making responsibilities and contingencies explicit.

Why a Buyer Agent Agreement Matters for Buyers and Agents

Who Typically Completes and Relies on This Agreement

The agreement is completed when a buyer engages an agent and when brokerage compliance records are required.

  • Homebuyers or investor buyers who want formal representation and clear commission and service terms.
  • Licensed buyer agents or brokerages documenting scope of services, dual-agency disclosures, and commission arrangements.
  • Escrow/title officers and lenders who may request a copy for underwriting or file completeness.

Keep a signed copy with the transaction file and provide one to each party for clarity and compliance.

Signatory Roles and Typical Authority

The buyer (individual or entity) is the principal and must have authority to enter into contracts for the purchase; verify legal name and capacity before signing to avoid disputes.
