What the Real Estate Buyer Fee Addendum Is and When It Applies

A Real Estate Buyer Fee Addendum is a contract attachment that documents fees charged to a buyer in a real estate transaction, clarifying who pays specific closing or administrative costs and the timing of payment. It supplements the purchase agreement by itemizing amounts, describing services or assessments covered, and recording buyer acknowledgment to reduce post-closing disputes. The addendum can affect escrow instructions, lender approval, and prorations; it should be attached to the primary contract and signed by all parties to ensure enforceability and clear allocation of financial obligations under state contract law.

Why Use a Buyer Fee Addendum

Using a Real Estate Buyer Fee Addendum makes fee allocation explicit, reduces ambiguity about closing costs, and documents buyer acceptance of non-standard charges in writing, which helps prevent contractual disputes and contributes to a smoother closing process under applicable real property and contract law.

Why Use a Buyer Fee Addendum

Who Typically Prepares and Signs This Addendum

Common participants include listing agents, buyer agents, title officers, escrow officers, and buyers who are agreeing to pay specific additional fees not covered in the base purchase agreement.

  • Buyers and buyer agents who agree to third-party processing or administrative fees at closing.
  • Listing or seller agents when seller credits require matching buyer fee documentation.
  • Title and escrow officers who need written authorization to disburse funds or apply charges.

Core Elements to Include in a Professional Addendum

A complete Real Estate Buyer Fee Addendum contains discrete sections that identify the parties, itemize each fee, explain payment timing, reference the main purchase contract, and include signature blocks and dates to evidence agreement.

Parties

List buyer(s), seller(s), and agent(s) by full legal name exactly as in the purchase agreement.

Fee Schedule

Itemize each fee with a short description, dollar amount or formula, and whether it is one-time, refundable, or subject to adjustment.

Allocation

State explicitly who pays each fee (buyer, seller, or shared) and any limits or caps on amounts.

Effective Date

Specify the date the addendum is effective and whether it survives termination of the main agreement.

Payment Terms

Describe how the fee will be collected (escrow deduction, separate invoice, or at closing) and deadlines for payment.

Signature Block

Include printed name, signature, title where applicable, and date for all required signatories to confirm consent.

  • 01
Upload Document: Open the addendum PDF and confirm it matches the correct property and purchase agreement.
  • 02
Enter Parties: Fill buyer and seller legal names exactly as on the purchase contract.
  • 03
Itemize Fees: List each fee, amount, payer, and payment method with precise language.
  • 04
Sign and Date: Have all required parties sign and date the addendum to establish consent and timing.

How the Addendum Integrates with Closing Workflows

A buyer fee addendum becomes part of contract and escrow workflows once signed and delivered to title and escrow for inclusion in settlement statements.

  • Attach to Contract: Add the signed addendum to the primary purchase agreement package.
  • Notify Escrow: Provide addendum to escrow/title to update closing ledger and HUD-1/ALTA statements.
  • Confirm Lender Approval: If lender funds are involved, obtain lender approval for any fees affecting loan proceeds.
  • Disburse at Closing: Ensure disbursement instructions match the addendum when calculating final settlement.

Configuring Digital Workflows for Addendum Completion

Recommended workflow settings reduce signer friction and ensure auditable execution when using an eSignature and document management platform.

Technical Considerations for eSigning and eSubmission

Ensure the signing platform supports required authentication, audit trails, and document export formats for record retention.

Common Mistakes to Avoid When Preparing the Addendum

  • Using vague language for fees (for example, 'administrative fee') without a dollar amount leads to disputes and possible escrow rejection.
  • Mismatched party names or dates cause delays; use the exact legal names that appear on the purchase agreement and identification.
  • Failing to obtain lender approval when fees affect loan proceeds can trigger underwriting delays or require amendments before closing.
  • Not delivering the signed addendum to escrow and title early enough prevents correct settlement calculations and may postpone closing.
