What the Real Estate Centre Engagement Is

The Real Estate Centre Engagement is a written agreement that defines the working relationship between a real estate centre (agency or brokerage) and a client (seller, landlord, or property owner). It sets scope of services, exclusivity, fee or commission structure, term, renewal and termination rights, required disclosures, and any authority granted to list, market, or negotiate on the client’s behalf. When executed electronically, the agreement should meet ESIGN and state UETA requirements to ensure enforceability and a durable record of consent and signing events.

Why a Clear Engagement Matters for Transactions

A properly drafted engagement reduces disputes over authority, fees, and deliverables, clarifies timelines for marketing and closing, and creates an evidentiary record if a commission or performance dispute arises.

Why a Clear Engagement Matters for Transactions

Who Typically Completes This Engagement

Each signer should understand their obligations before signing and verify names, dates, and scope to avoid later rescission or dispute.

  • Brokers and agents responsible for listing or transaction coordination.
  • Property owners, landlords, and sellers granting authority to market or lease.
  • Property managers and asset managers arranging ongoing management services.

Essential Elements to Include in a Professional Engagement

A complete Real Estate Centre Engagement organizes key business terms and legal protections so both parties understand responsibilities, timing, and remedies without ambiguity.

Scope

Clear description of services (listing, marketing, showings, leasing, management) and any excluded services to prevent scope creep.

Authority

Specific powers granted to the brokerage (e.g., sign listing, accept offers, place signs) and any limitations or delegated decisions.

Dispute Terms

Governing law, arbitration or mediation preferences, and any required step before litigation to resolve commission or performance disputes.

Where to Send and File the Completed Agreement

Decide distribution and filing destinations before signing to ensure timely recording, escrow processing, or contract administration.

  • Client Copy: Send signed PDF to the owner and brokerage.
  • Transaction File: Store in brokerage transaction folder or document management system.
  • Escrow / Title: Provide copy to escrow or title when required.
  • County Recording: Record documents only when required by local rules.

Digital Signing and File Format Considerations

Platforms that retain an audit trail, support PDF/A output, and integrate with title/escrow systems reduce administrative friction.

  • File Types: PDF and DOCX are standard for templates and final records.
  • Integrations: Connect to CRM, cloud storage, and transaction management systems.
  • Authentication: Support email, SMS, KBA, or stronger methods as required.

Agreement obligations begin on the specified effective date.

Termination Notice:

Include required notice period for early termination in days or months.

Renewal Window:

Specify when renewal notices must be given to avoid auto-renewal.

Set response expectations for offers or marketing approvals.

Document Retention:

Notarization and Witness Steps for Real Estate Documents

Some real estate instruments require notarization or witnesses; follow the correct sequence to ensure the record is acceptable for recording or enforcement.

01

Confirm Requirement

Determine whether the specific instrument requires notarization or witnesses; deeds require notary in all states.

02

In-Person Notary

Schedule in-person notary when remote notarization is not permitted by state law.

03

Remote Notarization

Use RON if permitted by the state and meeting identity-proofing rules.

04

Witness Count

Check state rules — some states (e.g., Florida, South Carolina) require two witnesses for deeds.

05

Audio-Video Record

If using RON, preserve the required audio-video record according to state rules.

06

Notary Journal

Ensure the notary completes journal entries as required by local law.

07

Recording Prep

Confirm the county recorder’s formatting and margin requirements before submission.

08

Final Delivery

Return recorded originals or certified copies to parties and update transaction files.

Common Mistakes to Avoid When Preparing the Engagement

  • Using informal or incomplete party names that differ from title or tax documents, causing payment or recording delays.
  • Failing to state when commission is earned, which can lead to later disputes about entitlement.
  • Omitting effective date or renewal mechanics, producing ambiguity about when duties start or end.
  • Relying on informal consent without a durable execution record, increasing litigation risk if signatures are contested.

Consequences of an Inaccurate or Incomplete Engagement

Contract Voidability: May be contested and unenforceable
Commission Dispute: Leads to arbitration or litigation
Regulatory Complaint: Broker license investigations possible
Recording Rejection: County may reject improperly executed instruments
Operational Delay: Closings or listings can be postponed
Data Exposure: Improper handling may violate privacy rules
