What the Real Estate Change Request Is and when it applies

A Real Estate Change Request is a formal written notice used to propose or document modifications to an existing real estate transaction, lease, escrow instruction, title record, or contract term. Typical uses include correcting parties or property descriptions, updating mailing or lender information, changing closing dates, or requesting amendments to lease terms. The form records the requested change, affected parties, the effective date, and any supporting details required for approval, review, or recording. Proper completion preserves chain-of-title clarity and helps avoid recording errors or lender delays.

Why a clear Real Estate Change Request matters

A concise, correctly completed change request reduces processing delays, preserves legal notice to interested parties, and helps prevent adverse outcomes such as rejected recordings or financing holds.

Why a clear Real Estate Change Request matters

Who prepares and who receives a Real Estate Change Request

Common preparers include title agents, closing attorneys, property managers, landlords, escrow officers, listing brokers, and borrowers initiating changes to recorded or pending documents.

  • Title companies and escrow agents who manage recording and chain-of-title updates.
  • Lenders and mortgage servicers when loan or payoff information requires correction.
  • Property managers and landlords for lease amendments or tenant contact changes.

Recipients typically include counter-parties, title companies, county recording offices, lenders, escrow agents, and any party named in the original instrument who must approve or acknowledge the change.

Step-by-step: completing a Real Estate Change Request

Follow a consistent order to minimize omissions and make review straightforward.

  • 01
Identify document: Name the original instrument and recording details.
  • 02
Describe change: State the precise amendment language or corrected text.
  • 03
Attach support: Include deeds, affidavits, or lender letters as needed.
  • 04
Sign and date: Signed by authorized party and dated on execution.

Where to file or send a completed change request

Route the form to the parties and offices that have authority or interest; stamping and recording rules vary by jurisdiction and document type.

  • Title Company: Primary recipient for chain-of-title or recording requests.
  • County Recorder: Send when a corrected or supplemental recorded instrument is required.
  • Lender or Servicer: Provide when loan documentation or payoff instructions are affected.
  • Other Parties: Notify sellers, buyers, tenants, or managers as required.

Digital submission and signing essentials

Use secure eSubmission channels that maintain audit trails, signer attribution, and tamper evidence when switching from paper to electronic workflows.

  • File formats: PDF or DOCX preferred
  • Authentication: Email, SMS code, or stronger methods
  • Audit data: IP and timestamp required

Essential components to include on a professional change request

A complete form combines identity, context, the requested amendment, supporting evidence, and clear execution blocks so reviewers can accept and record changes efficiently.

Document reference

Exact recorded instrument citation (book/page or document number) so the change links unambiguously to the original record and avoids misapplication.

Legal description

Full legal description or parcel identifier; a street address alone is usually insufficient for recording or title work.

Precise amendment

Clear redline-style language showing original text and exact replacement or correction to eliminate interpretation disputes.

Authority statement

Signer capacity (owner, trustee, attorney-in-fact) and authority reference, such as a recorded power of attorney when signing for another.

Supporting attachments

Include affidavits, corrected deeds, lender letters, or court orders that substantiate the requested change and speed review.

Execution block

Signature lines with printed name, title, date, and space for notarization or witness information when required.

Core data elements the form should capture

Document ID: Recorded reference
Property: Legal description
Requestor: Name and role
Change detail: Exact wording
Effective date: MM/DD/YYYY
Signature: Signer and capacity

Risks and potential penalties from incorrect or late change requests

Recording refusal: County may reject incorrect submissions
Title defects: Unresolved errors can cloud title
Loan delays: Lender may withhold funding
Contract breach: Counterparty claims or damages
Increased costs: Additional filing or correction fees
Tax issues: Misstated parties affect billing

Common preparation mistakes to avoid

  • Using a street address instead of the legal description, which can cause recording rejections or title ambiguity.
  • Mismatching party names or not including signer capacity (for example signing as trustee), leading to lender or recorder refusal.
  • Failing to attach required supporting documents, such as a corrected deed or a power of attorney, which delays approval.
  • Not allowing adequate time for lender review or county recording; rush fees or missed deadlines can result.

Real-world examples of change requests in practice

Two customer scenarios illustrate how properly executed change requests reduce friction and preserve closing schedules.

Optica Ventures — correction

As a venture property firm, Optica discovered a misspelled grantee name on a recorded instrument

  • The title team submitted a corrected change request with supporting ID
  • The correction was accepted with minimal delay, preserving investor funding timelines and avoiding re-opening escrow.

Martin Properties — lease amendment

A property manager needed to change lease contact and payment instructions mid-term

  • The manager used a signed change request with landlord and tenant approvals
  • The clear amendment reduced accounting errors, maintained rent flow, and created an auditable record for audits and tenant inquiries.

Typical timelines and processing expectations

Processing times vary by county and lender; plan for local recording and review lead times when scheduling closings or tenancy changes.

County recording time:

Often 7–30 business days depending on county workload

Lender review period:

Allow 3–10 business days for lender approval

Title company turnaround:

Title re-issuance commonly 5–15 business days

Notary availability:

Same-day for local notaries; RON sessions may be scheduled

Urgent filings:

Expedited or overnight services may reduce delay but add fees
