What a Real Estate Community Agreement Covers

A Real Estate Community Agreement is a legally binding contract among property owners, a developer, and the homeowners association (HOA) or community association that sets rules for shared spaces, maintenance responsibilities, use restrictions, assessments, governance procedures, dispute resolution, and architectural controls. It typically includes covenants, conditions, and restrictions (CC&Rs), declarations of common areas, a schedule of assessment obligations, and procedures for meetings and enforcement. The agreement governs relations among owners and between owners and the association for the life of the development or as specified in the document.

Why this Agreement Matters for Property Owners and Managers

A clear Real Estate Community Agreement reduces disputes, clarifies maintenance and assessment duties, and preserves property values by documenting rights and obligations. It provides an enforceable framework for community governance and dispute resolution while enabling consistent administration across lots and common areas.

Why this Agreement Matters for Property Owners and Managers

Who typically prepares, approves, and signs this agreement

Roles can overlap; legal review is common before recording or when assessing substantive amendments to governance or financial provisions.

  • Developers and sponsors — draft initial declaration, map common areas, fund initial reserves and establish governance structure.
  • Homeowners association boards — adopt bylaws, enforce CC&Rs, set assessments, and manage maintenance duties.
  • Property managers and legal counsel — administer daily operations, prepare amendments, and handle enforcement and collections.

How to configure an online signing workflow

Set up a secure, auditable e-signing workflow that enforces signer order, authentication, and records retention.

Field Configuration
Signer Order Define sequence for developer, HOA board, and purchasers
Authentication Use email + SMS code or stronger ID verification for high-value signings
Notary Integration Include remote online notarization (RON) or attach in-person notary steps
Audit Trail Capture IP, timestamp, and action log for each signer

Digital signing and file-format considerations

Ensure the chosen platform supports required integrations (e.g., county recorder export), audit trails, and any needed attestations such as a HIPAA BAA where relevant.

  • Accepted Formats: PDF, DOCX
  • Authentication Options: Email, SMS, KBA
  • Integrations: CRM and cloud storage

Where to send or record the agreement after signing

After execution and notarial acknowledgment where required, route the agreement to the county recorder, HOA records, and all parties; retain copies for governance and compliance.

  • County Recorder: Record declaration or amendment with local recorder
  • HOA Records: Store signed original in association files
  • Owner Copies: Provide each owner a copy via secure delivery
  • Digital Archive: Preserve signed PDF and audit trail

Common preparation mistakes to avoid

  • Using inconsistent party names or abbreviations that do not match title or corporate records
  • Omitting precise legal descriptions of lots and common areas, causing recording rejections
  • Failing to obtain required notarizations or witness signatures before recording
  • Neglecting to set clear assessment calculation methods and dispute-resolution steps

Consequences of incorrect or incomplete agreements

Recording Rejection: Improper acknowledgements can prevent recording
Enforcement Limits: Vague covenants weaken lien and fine authority
Financial Exposure: Undefined assessment rules increase litigation risk
Tax & Reporting: Missing records can affect tax treatment
Contractual Disputes: Ambiguous amendment clauses prompt disputes
Regulatory Noncompliance: Violating state recording statutes triggers penalties
