What the Real Estate Contract for Signature Is

A Real Estate Contract for Signature is a written agreement that records the negotiated terms of a property transaction, lease, or assignment and is prepared for execution by the parties. It can be completed as a paper form or electronically using an eSignature platform; when signed digitally it must meet the legal tests for e-signatures under the ESIGN Act (15 U.S.C. ch. 96) and applicable state law. The contract typically includes price, property description, parties, contingencies, dates, and signature blocks for all signatories and any required witnesses or notary acknowledgements.

Why a Properly Executed Contract Matters

A complete, correctly signed real estate contract creates enforceable rights and obligations, reduces closing delays, and provides a clear record for title searches and escrow. Electronic execution can speed routing and capture an audit trail while preserving legal validity under ESIGN and UETA when requirements are met.

Why a Properly Executed Contract Matters

Who Typically Prepares and Signs These Contracts

Real estate contracts involve multiple roles from listing agents to buyers, lenders, and attorneys; each has distinct responsibilities.

  • Listing agents and brokers: prepare contract templates, disclose property details, and coordinate signatures and delivery to escrow or title.
  • Buyers and sellers: confirm terms, sign offer and acceptance, provide deposit instructions, and satisfy contingencies within deadlines.
  • Lenders and title companies: review contract provisions, require additional signatures for financing or title insurance, and receive fully executed originals.

Clear role definition at the start of the transaction reduces duplicated work, ensures the necessary approvals are collected, and shortens time to close.

Step-by-Step: How to Complete the Contract

Follow a consistent sequence to reduce errors and meet legal requirements for execution and recordation.

  • 01
    1. Draft: Enter parties, property description, consideration, and contingencies.
  • 02
    2. Review: Have counsel or agent confirm disclosures and financing clauses.
  • 03
    3. Sign: Collect signatures, dates, and any witness or notary acknowledgements.
  • 04
    4. Deliver: Send executed copies to escrow, title, and lenders with audit trail.

  • Using inconsistent party names that do not match IDs or title vesting, causing delays in escrow and title insurance issuance.
  • Failing to note contingency deadlines clearly, which can unintentionally waive inspection or financing protections.
  • Not capturing witness or notary acknowledgements when required by state law, risking rejection by county recording offices.
