Default, Remedies, and Indemnity

The remedies available upon default by either party are as set forth in the Agreement, except as modified herein. If Buyer defaults, Seller may elect to retain earnest money as liquidated damages or seek specific performance or other remedies at law or equity. If Seller defaults, Buyer may elect to terminate and receive return of earnest money or pursue specific performance. Each party indemnifies the other for losses arising from material misrepresentations contained in the party's representations in this Rider.

Additional Terms and Special Provisions

This Rider shall be governed by and construed in accordance with the laws of the state of .
