What the Real Estate Customer Selection Form Is

The Real Estate Customer Selection Form is a structured document used by brokers, agents, and property managers to collect and record client preferences, qualifications, and authorizations needed to match buyers or renters with suitable properties. It captures identifying information, financing or proof-of-funds details, property and neighborhood preferences, any special requirements, and consent for disclosures and communications. The form creates a consistent record that supports compliance with state disclosure rules, backup withholding checks when applicable, and internal selection workflows while producing an auditable trail for later review.

Why a Formal Selection Form Matters for Transactions

A standardized Real Estate Customer Selection Form reduces ambiguity, ensures key data is collected uniformly, supports fair-treatment documentation, and helps teams route eligible customers into the right sales or leasing channels quickly and consistently.

Why a Formal Selection Form Matters for Transactions

Who Typically Completes the Form

The Real Estate Customer Selection Form is used by multiple roles in residential and commercial transactions.

  • Listing agents and brokers who screen prospective buyers or tenants before showings.
  • Leasing coordinators and property managers who confirm applicant eligibility and preferences.
  • In-house sales teams and referral partners who need a consistent intake record.

Use the form at intake or during pre-qualification to avoid rework and document selection decisions.

Key Signatories and Responsible Parties

Listing Agent — Broker

The listing agent signs to confirm they collected the client's preferences and verified identity where required. The agent is responsible for documenting any disclosures and retaining the completed form per company retention rules.

Customer — Buyer/Tenant

The buyer or tenant signs to confirm accuracy of information, consent to communications and disclosures, and acknowledgment of any selection criteria or priority rules applied during property matching.

Core Sections Every Professional Real Estate Customer Selection Form Should Include

A clear structure helps users complete the form quickly and ensures reviewers can find required elements during screening and compliance checks.

Client Identity

Full legal name, preferred name, government ID type and number, date of birth, and primary contact details so identity verification and background checks can be performed reliably.

Property Preferences

Desired property type, bedrooms, budget range, must-have features, acceptable neighborhoods, and any accessibility needs to filter listings against client requirements.

Selection Criteria

Priority rules or scoring used by the brokerage (e.g., first-come, credit threshold, owner approval) recorded to show consistent, non-discriminatory selection decisions.

Consent & Disclosures

Consent to electronic communications and disclosure of material facts, including any state-mandated language and ESIGN consumer disclosure when required for consumer-facing processes.

  • Missing consent for electronic records where ESIGN consumer disclosure is required for consumer-facing processes.
  • Using ambiguous budget descriptions instead of explicit numeric minimum and maximum values, which complicates automated matching.

Potential Risks and Compliance Consequences

Incorrect Tax Data: May trigger backup withholding or IRC §6721 penalties
Privacy Breach: Unauthorized disclosure risks HIPAA or state privacy enforcement
Invalid Consent: Missing ESIGN consumer disclosure can undermine electronic records
Improper Notarization: Noncompliant notarization voids legal effect
Discrimination Risk: Inconsistent selection criteria may violate fair housing laws
Retention Failure: Failure to retain records risks regulatory penalties
