What the Real Estate Document MiRealSource Is

The Real Estate Document MiRealSource is a standardized form used in property transactions to record key terms, parties, and disclosures for residential and commercial matters. It collects seller and buyer information, property identifiers, agreement dates, and signature blocks for all parties. The template is designed to be clear for recording, to support eventual county recording or electronic submission where permitted, and to integrate with workflow systems for routing, review, and retention. Use of a consistent format helps reduce errors, speed processing, and support compliance with state recording rules.

Why MiRealSource Matters in Property Workflows

MiRealSource centralizes required disclosures, property data, and signature fields so parties and filing agents have a single authoritative record. A complete MiRealSource reduces rework at county recorders, clarifies obligations between parties, and supports electronic handling where allowed under ESIGN and state law.

  • Mismatched party names or missing middle initials can trigger identity checks and require re-execution of the document.
  • Failing to include required state-specific disclosures may result in rescission rights or civil penalties under consumer protection laws.
  • Omitting notarization or incorrect witness counts can make the document unrecordable or subject to later challenge.

Risks and Potential Consequences of an Incorrect MiRealSource

Recording Rejection: Missing or incorrect fields may cause county clerks to refuse recordation.
Title Defects: Incomplete attachments can create title exceptions and impede transfers.
Rescission Risk: Statutory disclosure failures may allow buyer rescission in some states.
Tax Exposure: Incorrect consideration amounts can create reporting issues with tax authorities.
Notary Noncompliance: Improper notarization may void an acknowledgement or require re-execution.
Professional Liability: Agents or attorneys may face malpractice or licensing complaints for negligent preparation.
