By signing below, the Landlord/Manager and Tenant certify that the entries in this ECR & Inventory are accurate and constitute the parties' record of the condition and inventory of the premises at the time of inspection. Any items noted as damaged or in need of repair are accurately described in this report. This ECR shall be used for comparison at the termination of tenancy to determine any damage or missing items beyond ordinary wear and tear.

Disputes regarding entries in this ECR must be provided in writing to the other party within 5 business days of signing. Failure to timely notify the other party does not waive rights related to hidden defects or conditions discoverable only after occupancy, subject to applicable law.

Governing Law: This ECR shall be governed by the laws applicable to the lease of the premises. This ECR together with the lease constitutes the entire written understanding between the parties with respect to the condition and inventory at commencement of tenancy.

What the Real Estate ECR & Inventory Records

The Real Estate ECR & Inventory is a combined entry-condition report and itemized inventory used to document a property's physical condition and furnishings at move-in, move-out, or during inspections. It records room-by-room condition notes, appliance status, meter readings, and photographic evidence to establish a neutral baseline for deposit disputes, repairs, insurance claims, and maintenance tracking. The form is commonly used by landlords, property managers, tenants, and inspectors to create a reproducible, time-stamped record that can be stored electronically or printed for legal or accounting purposes.

Why this ECR & Inventory matters for property management

A clear ECR & Inventory reduces later disputes, clarifies repair responsibility, and preserves evidence of condition. Accurate records support security-deposit accounting, insurance claims, and scheduled maintenance while improving transparency between parties.

Who completes and relies on the ECR & Inventory

Typical users include professional property managers, leasing agents, owners, on-site inspectors, and tenants who need an objective condition record.

  • Tenants required to verify listed conditions and acknowledge inventory items for deposit protection.
  • Third-party inspectors and contractors who record defects, maintenance tasks, and repair completion.

Each user type has distinct responsibilities: the sender prepares the template, signers confirm accuracy, and recordkeepers retain the final signed copy.

Common preparation and documentation pitfalls

  • Missing or unclear photos that fail to show scale, date, or exact location in the unit.
  • Using vague condition language like 'okay' or 'needs attention' without specifics and measurements.
  • Failure to match signer names to government-issued IDs or lease records undermines attribution.
  • Not preserving an unaltered, time-stamped version of the signed report for future disputes.

Risks and consequences of incomplete or inaccurate records

Deposit disputes: Increased litigation risk and contested refunds
Insurance claims: Weaker supporting evidence for damage claims
Repair delays: Ambiguity about responsibility and timing
Regulatory noncompliance: Late accounting or improper notices risk fines
Evidentiary gaps: Missing audit trail reduces proof in court
Tenant relations: Poor documentation can erode trust and retention
