What the Real Estate eRecording Document Is

A Real Estate eRecording Document is a deed, mortgage, lien, or other instrument prepared for electronic submission to a county recorder or land records office. It includes the legal text plus metadata and a notary/acknowledgement block formatted for online filing and compliant electronic notarization or signature workflows.

Why an eRecording Document Matters for Transactions

Using an eRecording format reduces manual handling, helps preserve recording order, and supports faster confirmation from recorder offices. Electronic submission aligns with U.S. legal frameworks (ESIGN and UETA) when the transaction and jurisdiction permit it.

Why an eRecording Document Matters for Transactions

Who Typically Prepares and Uses These Documents

Real estate attorneys, title companies, lenders, closing agents, and county recorders commonly prepare or receive eRecording documents for filing.

  • Title companies and closers managing high-volume recordings for purchases and refinances.
  • Lenders and servicers submitting mortgage and release instruments.
  • County recorder staff processing eRecorded submissions and returning confirmations.

Step-by-step: Completing a Real Estate eRecording Document

Follow a clear sequence to minimize rejections: prepare the document, include required metadata, obtain valid signatures/notary, convert to the required file format, and submit to the recorder with payment and contact details.

  • 01
Prepare: Include full legal names, legal description, and consideration details.
  • 02
Authenticate: Signer identity and notary verification per state RON/IPEN rules.
  • 03
Format: Convert to recorder-accepted PDF/A or flattened PDF with proper metadata.
  • 04
Submit: Send via the recorder portal or authorized eRecording vendor.

Essential Components of a Professional eRecording Document

A compliant eRecording document contains specific structural elements designed for both legal sufficiency and recorder acceptance.

Legal Description

A precise property description (lot, block, metes-and-bounds) identical to recorded records; essential for accurate parcel indexing and priority determination.

Grantor and Grantee Details

Full legal names, entity type, and any required identifiers (EIN or trust name) to ensure correct party attribution and title continuity.

Consideration Clause

Clear statement of value or consideration supporting the transfer; used by recorders and taxing authorities to classify instruments.

Notary Acknowledgement

State-compliant acknowledgement or jurat; for RON include remote notarial statement and audio-video session identifier where required.

Recording Metadata

Machine-readable fields: parcel ID, document type, fee codes, and submitter contact information for automated processing by the recorder.

Signature Blocks

Properly placed signature and date lines for each signer, with corporate officer titles or capacity statements where an entity signs.

Setting Up an eRecording Workflow

Configure a digital workflow that matches recorder requirements, signer authentication, and file-format restrictions to reduce rejections.

Field Configuration
Submission Method Use direct eRecording gateway or approved vendor portal.
Authentication Apply email, SMS, or KBA per state and risk level.
File Format PDF/A preferred; flattened pages and embedded fonts recommended.
Metadata Fields Populate parcel ID, recording type, and contact info accurately.

How eRecording Submission Typically Flows

A predictable flow reduces errors: prepare document, collect signatures/notary, format file, submit through eRecording channel, and receive confirmation with recording number.

  • Prepare: Finalize legal text and attachments before signing.
  • Sign / Notarize: Acquire signatures and state-compliant notarial language.
  • Submit: Upload PDF with required metadata to the eRecording portal.
  • Confirm: Recorder issues a stamped copy and recording reference.

Technical and Platform Requirements for eRecording

eRecording platforms must support required file formats, secure transmission, and recorder-specific metadata to be accepted by county systems.

  • File Formats: PDF/A or flattened PDF accepted by most recorders.
  • Security: TLS encryption in transit and AES-256 at rest expected.
  • Integrations: Common integrations: title systems, CRMs, and document repositories.

Security and Compliance Elements to Include

Encryption: TLS 1.2/1.3 in transit, AES-256 at rest
