What the Real Estate Final Selection Is

The Real Estate Final Selection is a transaction document that records the buyer's confirmed choice of property and the essential deal terms immediately before closing. It consolidates the legal property description, agreed purchase price, identified fixtures and personal property, outstanding contingencies (inspections, financing, appraisal), proposed closing date, escrow instructions, and allocation of closing costs. The Final Selection functions as a contemporaneous memorandum of mutual acceptance used to move title, title insurance, and recording processes forward; it may require notarization or witnesses depending on state law, and it is generally executable electronically under ESIGN and state UETA frameworks.

Why a Clear Final Selection Matters

A concise Final Selection reduces ambiguity at closing, aligns buyer and seller expectations, and shortens title and escrow processing times.

Why a Clear Final Selection Matters

Who typically completes the Final Selection

The Final Selection is completed by the buyer with input from the listing agent, buyer's agent, and closing attorney or title officer.

  • Homebuyers and investors confirming property choice and contingencies during closing preparations.
  • Listing and buyer agents coordinating included items, repairs, and closing logistics, often on behalf of clients.
  • Title officers or closing attorneys verifying legal descriptions, recording instructions, and linkages to escrow files.

The document ensures all stakeholders have the same final transaction record and supports smooth coordination of closing tasks.

Core elements to include in a professional Final Selection

A complete Final Selection organizes transaction-critical data into discrete sections so title, escrow, lenders, and counsel can act without follow-up.

Parties & Roles

Full legal names for buyer(s), seller(s), listing agent, buyer agent, title company, and escrow officer; include company names and contact points for service.

Property Details

Complete legal description, street address, parcel/tax ID, and any unit or condo identifiers used for title and recording work.

Purchase Terms

Agreed purchase price, earnest money amount and holder, prorations, and any adjustments or credits agreed at final review.

Contingencies

Inspection, repair allowances, financing and appraisal conditions, and deadlines that must be satisfied prior to closing.

Closing Instructions

Target closing date, funding source, escrow disbursement instructions, and specific title insurance endorsements requested.

Signatures

Signature blocks for buyers and sellers, date lines, and notarization or witness lines if required by state law or lender policy.

Step-by-step: completing the Final Selection

Follow these sequential steps to prepare a Final Selection that closes without administrative hold-ups.

  • 01
Gather Documents: Collect contract, title report, inspection, and lender instructions.
  • 02
Confirm Terms: Verify price, fixtures, contingencies, and prorations with both parties.
  • 03
Populate Form: Enter legal descriptions, names, dates, and closing instructions exactly.
  • 04
Sign and Verify: Obtain signatures, notarization or witnesses as required and distribute final copies.

How the Final Selection moves a transaction forward

The Final Selection creates a single, machine-readable summary that triggers title, escrow, and lender workflows.

  • Upload: Send the populated Final Selection to title and escrow as PDF or DOCX.
  • Review: Title and lender verify legal description, liens, and encumbrances.
  • Authorize: Parties sign; lender confirms funding conditions are met.
  • Close: Funds wire, documents recorded, and final disbursements made per instructions.

Digital delivery and platform expectations

Choose a platform that supports standard file formats, secure authentication, and audit trails to expedite closing.

  • File Formats: PDF and DOCX are widely accepted and preserve layout.
  • Authentication: Email link, SMS code, or stronger methods like KBA or SSO.
  • Integrations: CRM and title systems via connectors speeds processing.

Common timing checkpoints and recommended windows

Typical transaction timelines vary, but these checkpoints are commonly used in purchase contracts and escrow instructions.

Inspection Period:

7–14 days to complete inspections and request repairs.

Financing Contingency:

21–30 days for loan approval and commitment letter.

Title Review:

7–14 days for preliminary title exceptions and cures.

Earnest Money Deposit:

Due within 1–5 days per contract instructions.

Scheduled Closing:

Date agreed by parties when all conditions are satisfied.

Common preparation mistakes to avoid

  • Using informal or incomplete legal descriptions that delay recording and title issuance.
  • Mismatched party names between contract, ID, and title documents that require corrective deeds.
  • Missing notarization or witness lines when state law or lender policy requires them.
  • Failing to reconcile inspection and repair language with closing credits or escrow holdbacks.

Risks and legal consequences of an incorrect Final Selection

Recording Rejection: County recorder may refuse to record incorrect deeds.
Title Defects: Unresolved exceptions can impair ownership and insurance.
Contract Breach: Disagreement over terms may trigger damages or rescission.
Funding Delays: Lender conditions unmet can postpone closing and incur fees.
Tax Exposure: Incorrect proration entries affect tax reporting and liabilities.
Invalid Signature: Improper notarization or missing witness may void parts of the document.
