What the Real Estate Inspection Addendum Is and When It Applies

The Real Estate Inspection Addendum is a contract attachment used in U.S. property transactions to record inspection findings, identify the inspector, and link those findings to the purchase agreement. It specifies the inspection scope, date, and documented defects, and it establishes buyer remedies such as repair requests, credits, or contract termination. The addendum sets deadlines for inspection completion, seller response, and buyer acceptance. Properly completed and signed, it creates enforceable, contract-level obligations that clarify responsibilities and reduce post-closing disputes over property condition.

Why an Inspection Addendum Matters in a Property Sale

A Real Estate Inspection Addendum creates a clear, written process for reporting defects, requesting repairs or credits, and preserving buyer termination rights. It reduces ambiguity, documents timelines, and establishes the contractual mechanism for resolving condition-related disputes before closing.

Who Completes and Relies on the Inspection Addendum

Buyers, sellers, listing agents, buyer agents, and licensed inspectors commonly complete the Real Estate Inspection Addendum during contract negotiation and contingency periods.

  • Buyer agent — requests inspections, negotiates repairs or credits, and tracks deadlines for contingencies.
  • Seller or listing agent — receives notices, coordinates access, and responds to repair requests promptly.
  • Licensed inspector — documents defects, provides written report, and may testify to condition if needed.

Lenders, title companies, and attorneys also review inspection addenda to assess closing risks and compliance with contract conditions.

Common Preparation and Execution Errors to Avoid

  • Incomplete or ambiguous defect descriptions lead to disputes; lack of photos or report references often forces escrow delays and additional inspections.
  • Missing or inconsistent party names, dates, or contract references can render the addendum unenforceable or delay lender acceptance.
  • Failing to specify contractor standards or licensing for repairs creates ambiguity about acceptable workmanship and may cause post-closing claims.
  • Ignoring lender or title company requirements about notarization or delivery format can block closing until corrected.

Practical Risks and Consequences of Errors

Contract Breach: Risk of litigation or damages.
Closing Delay: Escrow and settlement postponement.
Repair Costs: Unplanned out-of-pocket expenses.
Loss of Contingency: Buyer may lose termination rights.
Title Objections: Title company may require corrections.
Lender Rejection: Mortgage approval may be delayed.
