Report Delivery and Use

The Inspector will prepare a written inspection report summarizing observed material defects and recommendations. The report will be delivered to Client within business days following completion of the inspection, in electronic format unless otherwise requested for an additional fee.

The inspection report is prepared exclusively for the Client named herein and is for the Client's use in the purchase, sale or ownership decision regarding the Property. The report is not a warranty or guarantee of the condition of the Property.

Limitations, Exclusions and Client Acknowledgements

The inspection is visual and non-destructive. Inspector will not perform invasive or destructive testing, disassemble equipment, move furniture, or remove coverings. The inspection excludes latent, concealed or underground conditions and any component not readily visible, accessible or subject to seasonal variation. The following items are expressly excluded unless separately contracted: environmental testing (asbestos, lead, radon unless selected above), mold remediation verification, underground plumbing or drainage, septic system evaluation, and code compliance analysis.

Client acknowledges receipt of a copy of this Contract and consents to Inspector's access to the Property. Client will ensure utilities are on and provide reasonable access. Client accepts that minor defects may not be discovered, and that the Inspector's opinion is professional judgment, not an insurance policy or guarantee.

Limitation of Liability; Indemnity; Remedies

Inspector's liability for any claim arising from this Contract, whether in contract, tort, negligence or otherwise, shall not exceed the total amount of fees paid by Client to Inspector under this Contract. Under no circumstances shall Inspector be liable for consequential, incidental, special, or punitive damages. Client agrees to indemnify, defend and hold Inspector harmless from claims arising from Client's actions or misrepresentations to third parties.

Exclusive remedy for disputes under this Contract shall be limited to arbitration/mediation or small claims as selected below. Client and Inspector agree to attempt good-faith informal resolution prior to initiating formal dispute procedures.


Governing Law; Entire Agreement

This Contract shall be governed by the laws of the state in which the Property is located. This Contract, together with any attachments or addenda, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior understandings, whether written or oral.
