This Inspection Notice is provided pursuant to the contract between Buyer and Seller governing the transfer of the Property. Buyer has conducted or arranged for the inspection(s) identified above and furnishes this Notice to request responses or corrective action. Seller's obligations are governed by the terms of the underlying purchase agreement; to the extent this Notice requests repairs or credits, Seller's acceptance is required in writing unless the purchase agreement establishes an alternative procedure.

If Seller elects to make repairs, Seller shall complete such repairs in a good and workmanlike manner by the agreed cure date and shall permit Buyer or Buyer's representative a re-inspection. If Seller fails to respond in writing by the stated response deadline, Buyer reserves all remedies under the purchase agreement, including the right to terminate or to proceed to closing and seek credits or repairs by other means, as permitted by contract. Time is of the essence with respect to any deadlines provided herein.

Buyer acknowledges that any cost estimates delivered with this Notice are preliminary and not final contractor bids unless expressly stated. Seller is not required to perform work beyond statutory or contractual obligations. Any agreement to perform repairs shall be documented in writing and will amend the purchase agreement only if signed by both parties or otherwise permitted by the purchase agreement.

This Notice, attachments, and any written response constitute the complete record of inspection-related requests between the parties and are subject to the dispute resolution, indemnity, and allocation of costs provisions of the purchase agreement. Governing law for any dispute arising from this Notice is the law specified in the purchase agreement; if none is specified, the law of the state where the Property is located governs.
