Inspector will perform a non-invasive, visual inspection of readily accessible components. This Proposal expressly excludes hidden or latent defects, code compliance reviews, design analysis, environmental sampling (unless selected), testing of concealed systems, destructive testing, concealed pest damage, and any work requiring invasive entry or removal of building materials. Inspector does not provide guarantees or warranties for future performance of inspected items.

Client acknowledges that the inspection is a professional opinion based on observations at the time of inspection and is not a substitute for comprehensive renovation, engineering, architectural, or other specialized evaluation. Recommendations for further evaluation will be made where appropriate.

Acknowledgement of Limitations:

Liability, Indemnity and Remedies

Inspector's liability for any claim arising from this Proposal or the inspection performed shall be limited to direct damages not to exceed the total amount of fees paid for the inspection services described herein. In no event shall Inspector be liable for consequential, incidental, punitive or special damages. Client agrees to indemnify, defend and hold harmless Inspector and its agents from any claims, liabilities or expenses arising from Client's failure to disclose material information or from conditions beyond Inspector's reasonable knowledge or control.

Client agrees that any claim relating to the inspection or report must be made in writing within 14 days of discovery of the alleged defect and no later than 90 days from the date of the inspection. Client's sole and exclusive remedy for any alleged breach shall be as specified in this clause.

Cancellation and Rescheduling

Cancellation or rescheduling by Client less than 48 hours before the scheduled inspection may result in forfeiture of the deposit or a cancellation fee equal to the deposit amount. Inspector reserves the right to reschedule for weather, safety, or access issues; if Inspector cancels, deposit will be credited or refunded.

Governing Law; Entire Agreement

This Proposal and any resulting agreement shall be governed by the laws of the state where the Property is located. This document, together with any attachments or accepted addenda, constitutes the entire agreement between the parties and supersedes all prior communications and proposals, whether oral or written, regarding the inspection services described herein.
