What the Real Estate Items For Sale document is

The Real Estate Items For Sale document lists tangible personal property and fixtures included or excluded from a real estate transaction, such as appliances, furniture, window treatments, and equipment. It identifies each item, its condition, any serial numbers or model identifiers, and whether the item transfers with the property or is retained by the seller. This record helps reduce post-closing disputes by creating a clear written agreement between buyer and seller and may be attached to the purchase contract, lease, or closing statement for reference and enforcement.

Why a clear items list matters in property transactions

A complete, signed items list reduces ambiguity at closing, limits post-closing disputes, and documents value for tax or insurance purposes while supporting enforcement of contract terms under ESIGN and UETA where e-signatures are used.

Why a clear items list matters in property transactions

Who typically prepares and relies on this list

Common participants who prepare or review the items list include parties to the sale and their agents; the following groups are typical.

  • Buyers and buyers' agents who verify included fixtures, appliances, and exclusions before closing.
  • Sellers and listing agents who document what remains with the property and avoid misunderstanding.
  • Closing agents and title companies who attach the list to closing files and record items for insured value.

Each party benefits from an explicit list: buyers get clarity on expectations; sellers limit future claims; agents reduce closing delays.

Core components of a professional items-for-sale list

A professional list is structured, precise, and attached to the main transaction documents; include clear identifiers and signatures to make the list enforceable.

Inventory List

Line-item entries with descriptions, quantities, and locations in the property to remove ambiguity about what is included.

Inclusion/Exclusion

Explicitly mark each item as 'Included' or 'Excluded' so ownership transfer is recorded and disputes are minimized.

Condition Notes

Record condition details and known defects to set expectations and avoid later claims about item condition.

Valuation

Where price or consideration attaches to an item, record the agreed value or note if included at no additional cost.

Signatures

Signature blocks for buyer and seller, with printed names and dates, provide execution evidence for enforcement and record retention.

Attachments

Supporting files such as appliance manuals, receipts, photos, and serial number lists are attached to strengthen the record.

Step-by-step: preparing and executing the items list

Follow these sequential steps to create and finalize the items-for-sale list efficiently and clearly.

  • 01
Compile Inventory: Survey property and list each item with identifying details.
  • 02
Document Condition: Note condition and capture photos as supporting evidence.
  • 03
Agree Inclusion: Buyer and seller confirm included and excluded items in writing.
  • 04
Sign and Attach: Execute with dated signatures and attach to the purchase agreement.

Configuring a digital workflow for the items list

Set these workflow fields when you prepare an electronic items list to ensure correct routing and authentication.

Field Configuration
Template Create reusable template with required fields pre-placed for consistency.
Signer Order Specify signer sequence (seller first, buyer second) to reflect negotiation flow.
Authentication Choose email link, SMS code, or stronger ID verification per transaction risk.
Reminders Set automated reminders and expiration to avoid signature delays.

Where to send and how to file the completed list

Use a clear routing path so the executed list is included in closing and retained with transaction records.

  • Prepare Document: Attach the items list to the purchase agreement or addendum.
  • Send to Parties: Route to buyer, seller, and agents for review and signatures.
  • Include at Closing: Deliver final executed copy to closing agent or title company.
  • Archive Copy: Store executed version with closing documents and property records.

Technical requirements for digital signing and storage

Confirm platform support for common file formats, integrations, and security standards before e-signing.

  • File Formats: PDF and DOCX are standard; ensure format preserves layout and metadata.
  • Integrations: Connectors for MLS, title systems, and cloud storage simplify routing and archival.
  • Security: Platform should support TLS and AES-256 encryption and an audit trail.

Use a platform that retains an unalterable audit trail, exports signed PDFs, and integrates with your closing or document management systems.

Key timing considerations and customary deadlines

Track these timing items to align the items list with contract contingencies and closing workflows.

Delivery Before Closing:

Provide a draft list during inspections or prior to final walkthrough.

Final Agreement Date:

Execute no later than closing date to bind the transfer of items.

Notary Scheduling:

If notarization required, schedule within days of closing to avoid delays.

Title Attachment:

Ensure the executed list is attached to closing package provided to title company.

Tax Reporting:

Retain records for tax or insurance purposes per applicable reporting schedules.

Common mistakes to avoid when preparing the list

  • Using vague descriptions such as 'all appliances' without itemizing brands and models invites post-closing disputes and differing interpretations.
  • Omitting serial numbers for appliances or electronics can prevent warranty transfers and complicate insurance claims after transfer of ownership.
  • Failing to sign or date the list on each page leaves gaps that opposing counsel may exploit in a contract dispute.
  • Not attaching photos or receipts reduces the evidentiary value of condition statements and weakens proof in claims or insurance reviews.

Risks and potential consequences of an incomplete or incorrect list

Contract Dispute: Post-closing claims over ownership or condition may lead to litigation.
Withholding Risk: Buyers may withhold funds if material items are disputed.
Tax Reporting: Incorrect valuation affects tax reporting and potential IRS issues.
Closing Delays: Missing notarization or signatures can delay or derail closing.
Invalid Transfer: Ambiguous language may nullify intended transfer of specific items.
Fraud Exposure: Misstated condition or serials can expose parties to fraud claims.

Real-world examples of items lists in real estate closings

These short case summaries illustrate how an items list was used in actual transactions to avoid disputes and speed closing.

Brian Fitzgibbons — Optica Ventures LLC

Brian created a standardized template for furnished rentals to list included furniture and electronics

  • Tenants reviewed and signed electronically
  • Using the template reduced misunderstandings and provided consistent records across multiple properties.

Formats and supporting documents to include with the list

Preserve evidentiary detail by attaching standard supporting documents and saving signed copies in common formats.

Signed PDF

Export a final, signed PDF with an embedded audit trail so the document is portable and admissible in many proceedings.

Photos & Receipts

Attach dated photos and original receipts to prove condition and purchase dates for warranties or insurance.

Serial Lists

Provide a separate serial number spreadsheet for electronics or appliances to aid warranty transfers and lender collateral checks.

Supplemental Forms

Include property disclosure forms, addenda, or lease exhibits that reference the items list for complete transaction context.

Security and compliance features to check

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
