Agent Obligations

The Agent will: (a) market the Property; (b) arrange accompanied viewings; (c) obtain tenant references and credit checks where instructed; (d) introduce the Owner to a suitable tenant and assist in documenting tenancy terms; and (e) promptly notify the Owner of all material offers. The Agent will keep records of viewings, offers and references and will provide copies to the Owner on request.

Owner Obligations

The Owner warrants that they are the legal owner of the Property and have full authority to grant the Agent the rights in this Agreement. The Owner will provide accurate property information, safety certificates and access for viewings, and will be responsible for compliance with statutory requirements relating to the Property. The Owner will promptly notify the Agent of any material change affecting the Property.

Fees and Payment

Commission becomes payable upon tenancy commencement, which is defined as the earlier of the date the tenant signs the tenancy agreement or the date the tenant first pays rent or deposit to the Owner or Agent.

Tenant Introduction, Holding Fees and Deposits

The Agent will introduce prospective tenants to the Owner. Where a holding fee or deposit is taken by the Agent, the Agent will hold such monies in a designated client account unless otherwise directed in writing by the Owner. The Owner instructs the Agent to:

Keys, Access and Inventories

The Owner will supply the Agent with agreed keys and access instructions. If an inventory is required, the Agent may arrange preparation at the Owner's expense. The Agent is not responsible for items of personal property or for safeguarding keys beyond reasonable care.

Liability, Indemnity and Warranties

The Owner indemnifies the Agent against all claims, losses and expenses arising from the Owner's breach of warranty, misrepresentation or failure to comply with statutory obligations. The Agent will not be liable for loss of rent or tenant default except to the extent caused by the Agent's negligence or wilful misconduct.

Default and Termination

This Agreement may be terminated by either party on written notice where the other party is in material breach and fails to remedy within a reasonable period after notice. Termination does not affect the Agent's right to commission in respect of tenancies procured by the Agent during the term of this Agreement where the tenancy arises from an introduction made by the Agent during the exclusive period.

Governing Law and Entire Agreement

This Agreement constitutes the entire agreement between the parties in relation to its subject matter and supersedes all prior negotiations and agreements. It is governed by the laws of the jurisdiction in which the Property is located.
