What the Real Estate Listing Attachment Is

A Real Estate Listing Attachment is an addendum to a listing agreement that records property-specific details, disclosures, and auxiliary terms not included in the main agreement. It commonly contains detailed property descriptions, seller-provided disclosures, marketing permissions, MLS submission instructions, and any attachments (floor plans, surveys, lead-based paint notices). The attachment is used by brokers and sellers to ensure consistency across marketing and contract documents and to provide buyers with required state and federal disclosures.

Why a Clear Listing Attachment Matters

A well-prepared Real Estate Listing Attachment improves accuracy, reduces post-listing disputes, and ensures required disclosures are visible to buyers and agents. It supports consistent MLS entries and helps demonstrate compliance with state disclosure obligations and interstate e-signature laws such as ESIGN and UETA.

Why a Clear Listing Attachment Matters

Who Typically Prepares and Signs This Attachment

Keep a copy with the listing file and distribute executed versions to all parties to reduce later disputes and support audit trails.

  • Listing brokers and agents who control marketing and MLS submission details
  • Property sellers who must provide accurate disclosures and ownership information
  • Buyers' agents and attorneys who review attachments for contract consistency

  • Not recording who received disclosures and when, creating ambiguity in buyer claims or regulatory reviews.

Key Risks and Consequences of Errors

MLS sanctions: Listing removal or fines
Title delays: Defects or mismatches cause closing delays
Regulatory exposure: State broker discipline possible
