What the Real Estate Listing Direction Is and How It’s Used

A Real Estate Listing Direction is a written instruction from a property owner or authorized agent that authorizes a broker or listing service to list a property for sale or lease, set listing terms, and take specified marketing actions. It typically records the parties, property description, listing price or rate, term, commission or fee arrangements, and any limited authorizations such as open house access or lockbox placement. The document clarifies authority, timing, and routing so brokers, MLS platforms, and cooperating agents can act consistent with the owner’s intent.

Why a Clear Listing Direction Matters for Transactions

A precise Listing Direction reduces ambiguity about who can list and market a property, helps prevent commission disputes, and documents the scope of authority for MLS submission and third-party vendors.

Why a Clear Listing Direction Matters for Transactions

Typical Users and Roles Involved

The document is used by property owners, brokers, and their support teams to assign listing authority and record core listing terms.

  • Property owners and sellers who authorize a broker to list and market the property for sale or lease.
  • Listing brokers and designated agents responsible for MLS submission, marketing, and negotiating offers.
  • Property managers or fiduciaries acting under power-of-attorney for owners who cannot sign in person.

Properly completed directions help cooperating brokers, title companies, and closing agents verify authority and avoid downstream delays.

How to Complete and Deliver the Listing Direction

Follow this sequence to prepare, sign, and route the Listing Direction for MLS and brokerage use.

  • 01
Prepare Document: Populate owner, property, price, term, broker, and special instructions.
  • 02
Review Legal Details: Confirm legal property description and verify signatory authority or POA.
  • 03
Sign and Date: Obtain all required signatures and dates; include capacity for each signer.
  • 04
Submit to Broker/MLS: Deliver signed copy to broker for MLS upload and retain a certified copy.

Where the Completed Form Is Sent and Who Acts Next

After signatures, the Listing Direction moves through a short workflow: broker intake, MLS upload, marketing, and record retention by parties.

  • Broker Intake: Broker verifies signatures and authorizations before accepting the listing.
  • MLS Submission: Broker uploads listing data and signed direction into MLS per local rules.
  • Marketing: Broker proceeds with agreed marketing actions and vendor engagements.
  • Record Retention: Broker and owner retain a copy for the term plus required retention periods.

Typical Digital Workflow Settings for eCompletion

Recommended configuration options when preparing the form for electronic signing and automated routing.

Field Configuration
Signature Type eSignature with audit trail
Authentication Email plus optional SMS code
Routing Sequential: owner → co-owner → broker
Storage Save signed PDF to secure cloud and MLS record

Technical and Integration Considerations for eSubmission

Choose a platform that supports secure eSignatures, audit trails, and integration with cloud storage to centralize signed directions.

  • Document Formats: PDF and DOCX supported
  • Integrations: Google Workspace, Microsoft 365, Box, NetSuite
  • Authentication: Email, SMS, or KBA options

Ensure the platform can produce a tamper-evident signed PDF and retain a detailed audit trail for compliance and future title verification.

Common Preparation Errors to Avoid

  • Using an informal or incomplete legal description that does not match county records and causes title verification delays.
  • Failing to list all owners or authorized signers, which can invalidate the direction and block MLS submission.
  • Omitting the signatory’s capacity (owner, trustee, POA), creating uncertainty about authority and risking later disputes.
  • Not retaining the signed original or certified copy, which complicates commission claims or title reviews.

Security, Privacy, and Compliance Measures to Include

Encryption: AES-256 at rest
Transport: TLS 1.2/1.3 in transit
Audit Trail: Timestamped signing log
Certifications: SOC 2 Type II
Legal Framework: ESIGN and UETA compliance
HIPAA Support: BAA available when required

Consequences of an Incorrect or Incomplete Direction

Unenforceable Terms: Key provisions may be voided
Commission Disputes: Leads to arbitration or litigation
MLS Rejection: Listing may be removed
Title Delays: Impacts closing schedule
Regulatory Fines: Brokerage penalties for licensing violations
Increased Costs: Attorney fees and corrective filings

Typical Timing and Deadlines to Track

Track key dates for listing effectiveness, MLS submission, disclosure delivery, and expiration to prevent missed obligations or automatic renewals.

Effective Date:

MM/DD/YYYY; determines when listing begins

MLS Upload Window:

Follow local MLS rules; often within 24–72 hours

Disclosure Delivery:

Deliver state-required disclosures per local statute timing

Listing Expiration:

End date of listing term; triggers renewal or removal

Document Retention:
