REAL ESTATE LISTING EXTENSION

This Listing Extension Agreement amends and extends the terms of the Listing Agreement originally entered into between the parties identified below. The parties agree that all terms of the original Listing Agreement remain in full force and effect except as expressly modified in this Extension. Unless otherwise defined herein, capitalized terms shall have the meanings ascribed in the original Listing Agreement.

The Listing Agreement is hereby extended for the period set forth above. Seller authorizes Broker to continue to market the Property and to cooperate with other brokers pursuant to the commission provisions set forth below.

Default, Remedies, and Protection Period

Except as expressly amended herein, the parties' rights and remedies for breach of the Listing Agreement shall remain as set forth in the Listing Agreement. In addition to any other remedies available at law or equity, Broker shall be entitled to recover its commission, costs and reasonable attorneys' fees if Seller breaches this Extension or the Listing Agreement and such breach results in Broker being prevented from performing its obligations or obtaining a sale. Seller expressly agrees that Broker shall be entitled to commission pursuant to this Extension if a transaction is contracted for during the extended term or within sixty (60) days after the expiration as to buyers introduced during the extended term.

Notices

All notices required or permitted under this Extension shall be in writing and delivered to the addresses set forth below. Notice shall be effective upon personal delivery, on the date of confirmed facsimile or electronic transmission when received during normal business hours, or three (3) business days after deposit with the United States Postal Service, postage prepaid, certified mail, return receipt requested.

Miscellaneous Provisions

Governing Law: The validity, interpretation and performance of this Extension shall be governed by the laws of the state of without regard to its choice-of-law rules.

Entire Agreement: Except as expressly modified by this Extension, the Listing Agreement remains unmodified and in full force and effect. This Extension together with the Listing Agreement constitute the entire agreement between the parties regarding the subject matter hereof and supersede all prior negotiations and understandings.
