Default, Remedies and Termination

Tenant's failure to pay rent, vacate upon lawful termination, or material breach of any covenant shall constitute default. Upon default Landlord may pursue all remedies available at law or equity, including termination of tenancy, recovery of damages, and costs of collection, including reasonable attorneys' fees where permitted by law.

Any acceptance of partial payments, late payments, or other concessions does not waive Landlord's right to enforce any term of this agreement unless a written waiver signed by Landlord states otherwise.

Governing Law; Entire Agreement

This agreement shall be governed by the laws of the state in which the Premises are located. This instrument contains the entire agreement between the parties relating to the subject matter hereof and supersedes all prior negotiations, representations and agreements, whether written or oral.
