State the precise effective date and any termination or review dates. Include notice periods for early termination and requirements for tenant communication to ensure legal compliance.

Financial Transfers

Document security deposit handling, rent account transfers, final accounting responsibilities, and any prepaid expense reconciliations to avoid liability disputes with tenants or owners.

Mismatched Names: Triggers withholding or bank account problems
Unclear Authority: Leads to vendor or tenant disputes
Late Filing: Possible fines or lender penalties
Incorrect Tax Info: Triggers backup withholding at 24%

Frequent Preparation Errors to Avoid

  • Incomplete party identification leads to delays and may cause banks or title companies to refuse account transfers or recording requests—verify entity names and EINs carefully.
  • Failing to specify authority scope often results in disputes over rent collection, lease renewals, and maintenance responsibilities during the transition period.
  • Not updating tenant notices and payment instructions causes missed rent and confusion; include clear effective dates and new payment routing instructions.
  • Assuming electronic notarization is accepted statewide can cause rejected recordings; confirm RON acceptance with county recorder or title insurer before relying on it.
