Certification and Documentation

Any party claiming military status must provide to the other party, within a reasonable time after request, a copy of official military orders, a command certification of active duty status, separation or retirement documentation, or other official documentary evidence sufficient to substantiate the asserted status. The providing party also consents to the limited disclosure of such documents to escrow agents, title companies, lenders, and legal counsel for confirmation of entitlement under this Addendum.

Effects on Agreement Performance

If a party provides satisfactory documentation showing that performance under the Agreement is materially affected by active military service or orders requiring relocation, that party may, by written notice and delivery of such documentation, elect one of the following remedies as applicable to the underlying Agreement:

(a) Termination: Immediate termination of the Agreement without penalty, in which case earnest money or security deposit shall be disbursed as follows unless otherwise provided in the Agreement: earnest money/security deposit to the depositing party, or other disbursement as mutually agreed in writing. Specify earnest money / deposit amount:

(b) Extension of Deadlines: Temporary extension of closing, possession, or performance deadlines for a period reasonably necessary to accommodate the military obligation, not to exceed days unless further extended by mutual written agreement.

Mutual Release and Deposit Handling

Upon an effective termination under this Addendum, the parties shall execute any release reasonably required by escrow, title, lender, or other third parties to effect the agreed disbursement of funds. Unless otherwise agreed in writing, the parties shall divide or return deposits consistent with the applicable remedy selected under this Addendum.

Default, Indemnity, Governing Law

Except as modified by this Addendum, all other terms and conditions of the underlying Agreement remain in full force and effect. A material breach or wrongful termination by a party not entitled to relief under this Addendum constitutes default under the Agreement and entitles the non-breaching party to pursue all remedies available at law or equity.

The party asserting military status shall indemnify and hold harmless the other party for claims, costs, and expenses arising from any fraudulent or knowingly false representation of military status or falsified documentation.

What the Real Estate Military Status Addendum Is

The Real Estate Military Status Addendum is a short written attachment used in property transactions and leases to record a party's current military status, duty station, and related protections. It clarifies whether a buyer, seller, landlord, or tenant is an active-duty service member, reservist, or dependent, and identifies supporting documentation. The addendum helps parties apply protections such as those under the Servicemembers Civil Relief Act (50 U.S.C. §3901 et seq.) and ensures closing, lease, or enforcement steps account for military service obligations and statutory stay periods.

Why a Military Status Addendum Matters in Real Estate

Recording military status reduces legal risk, preserves statutory protections for service members, and clarifies timelines for closing or eviction. The addendum provides a clear record for title officers, lenders, and property managers and supports documented consent for electronic signatures or notarization when needed.

Why a Military Status Addendum Matters in Real Estate

Who typically completes this addendum

Common users include agents, title officers, property managers, and the service members or their authorized representatives who must attest to status.

  • Real estate agents and brokers completing offer packages and disclosure packets for clients with military status.
  • Title companies verifying encumbrances and ensuring record accuracy before closing on properties involving service members.
  • Landlords and property managers documenting tenant status to comply with eviction or stay protections.

  • Title Review: Title officers note status to assess encumbrance timing and possible stays.

Essential components of a professional addendum

A well-drafted Military Status Addendum is concise, unambiguous, and includes attestations, document lists, and signature/verification blocks to support title, leasing, or court processes.

Clear Status Statement

A one-line declaration of military status (e.g., "I am currently on active duty in the U.S. Army"). This reduces ambiguity and provides a clear starting point for verification.

Authority to Sign

A block for an authorized representative or power of attorney when the service member cannot sign in person; include citation of the POA document attached and its effective date.

Supporting Documents List

A checklist of required evidence (orders, military ID, verification letter) with file-name guidance so reviewers can quickly match attachments to entries.

Service Dates

Fields for effective date, anticipated end of active service (if known), and statement about updates; dates affect statutory notice and stay calculations.

Notary or Verification

Designated area for in-person or remote online notarization, or for identity-proofing audit entries (method, credential used, verification timestamp).

Retention & Access

A short clause stating how long the addendum will be retained, who can access it, and that copies will be included in closing or lease files for compliance.

Security and compliance checks to include

Encryption: TLS 1.2/1.3 and AES-256
Audit Trail: Timestamped action log
HIPAA BAA: Execute BAA if PHI present
ESIGN / UETA: Legal framework compliance
Access Controls: Role-based permissions
Retention Policy: Preserve signed record copy

Common preparation and filing mistakes

  • Failing to attach verifiable military orders or using a partial document that omits duty dates, which delays verification and closing.
  • Listing a nickname or abbreviated name rather than the legal name; mismatched names can trigger title or landlord requests for re-execution.
  • Skipping the notarization or remote online notarization step when a third party specifically requires notarized evidence for a stay or exemption.
  • Not updating the addendum after a status change (activation, redeployment, discharge), which can lead to inaccurate records or enforcement actions.

Risks and potential consequences of errors

Legal Challenges: Contractual disputes
Delay to Closing: Escrow holdbacks
Eviction Complications: Stay requests may arise
Title Objections: Clearing encumbrances delayed
Regulatory Noncompliance: Misapplied protections
Re-execution Required: Additional administrative cost

Practical scenarios and how the addendum was used

Two typical scenarios show how a Real Estate Military Status Addendum clarifies transaction steps and preserves protections for service members.

Home Purchase with Deployment

A buyer deployed overseas attaches orders to an offer

  • The title company verifies deployment dates using attached orders
  • The addendum preserved the buyer's rights and allowed the closing timeline to be adjusted without dispute by documenting status and contact method for the POA.

Rental Eviction and Stay Request

A tenant notifies a landlord of active duty and submits orders

  • Landlord requests notarized verification before filing eviction
  • The notarized addendum and supporting documents enabled counsel to assess SCRA protections and adjust filing steps to avoid defective process.
