Effect of Amendment; Remaining Terms

This Amendment modifies the existing Listing Agreement and/or MLS entry identified above. Except as expressly modified herein, all terms, covenants, obligations and rights of the Listing Agreement and original MLS submission remain in full force and effect. In the event of any conflict between this Amendment and the original Listing Agreement or MLS entry, the terms of this Amendment control.

Default and Remedies

If a party materially breaches this Amendment, the non-breaching party may pursue all remedies available at law or in equity, including specific performance and recovery of reasonable attorneys' fees and costs incurred to enforce the terms of this Amendment, to the extent permitted by law and by the Listing Agreement.

Governing Law; Entire Agreement

This Amendment shall be governed by and construed in accordance with the laws of the state in which the Property is located. This Amendment, together with the Listing Agreement and any prior written amendments, constitutes the entire agreement between the parties relating to the subject matter hereof and supersedes all prior or contemporaneous negotiations, representations, or agreements, except to the extent expressly preserved.
