What the Real Estate Nonrealty Items document covers

A Real Estate Nonrealty Items document lists personal property and movable assets that are included with or excluded from a real estate transaction. Typical entries cover appliances, window coverings, light fixtures, freestanding furniture, security systems, and trade fixtures. The form clarifies ownership transfer, identifies serial or model numbers when relevant, and records any payment or credit for included items. Used alongside purchase agreements or bills of sale, it reduces closing disputes and provides a written record of tangible personal property exchanged at closing under U.S. property practice and contract law.

Why documenting nonrealty items matters in a closing

A clear nonrealty items list prevents post-closing disputes about ownership, supports accurate closing statements, and documents consideration for taxable transfers when necessary. It also records condition and any warranties, making obligations transparent for buyer, seller, and lenders.

Why documenting nonrealty items matters in a closing

Who typically completes and relies on this document

The Real Estate Nonrealty Items form is completed by parties to a transaction to record movable items and any agreed payments or exclusions.

  • Real estate agents and brokers — Prepare lists to include in offers and closing packages, avoiding later disagreements about included items.
  • Buyers and sellers — Confirm which appliances, fixtures, and personal property transfer with the sale and record condition or serial numbers.
  • Closing attorneys and title agents — Use the list to validate transfer of possession and to reconcile closing statements and bills of sale.

When completed and signed by both parties, the document becomes part of the transaction record and supports clear post-closing responsibilities.

Essential elements of a professional nonrealty items list

A well‑prepared document is concise, itemizes each asset, specifies condition and identifying details, and sets delivery and liability terms to reduce ambiguity at closing.

Itemized List

Individual line items with plain descriptions for each piece of personal property, avoiding broad categories that invite dispute.

Identification Details

Serial numbers, model numbers, and distinguishing marks when available to uniquely identify appliances or equipment being transferred.

Fixture Status

A clear statement whether an item is a fixture or removable personal property to resolve fixture vs nonrealty disputes.

Consideration

Any agreed payment, credit, or waiver tied to included items, stated as a specific dollar amount or zero where none applies.

Delivery Terms

When possession transfers, who moves the item, and any required condition on delivery or removal at closing.

Signatures

Signature blocks for buyer and seller with printed names and dates to confirm mutual acceptance and attribution.

Step-by-step: filling and submitting the nonrealty items list

Follow these sequential steps to complete the form accurately and include it in the closing package.

  • 01
Gather details: Collect make, model, serial numbers and condition notes for each item.
  • 02
Describe items: Enter clear descriptions line by line; avoid umbrella categories.
  • 03
Confirm consideration: Record any payment or credit for included items explicitly.
  • 04
Sign and date: Obtain signatures from buyer and seller, then include in closing documents.

How the document is processed during closing

Typical routing moves the item list from preparer to parties, then to the closing agent and title company for final records.

  • Prepare list: Seller or agent completes the form with item details.
  • Review by buyer: Buyer inspects and either accepts or requests changes.
  • Signatures captured: Both parties sign, using eSignature or ink as agreed.
  • Record keeping: Closing agent retains the executed copy with closing file.

Recommended digital workflow settings for online completion

Key legal risks if the list is incorrect or missing

Title disputes: Unclear ownership claims
Closing delays: Lender or escrow holdbacks
Tax exposure: Reporting errors or backup withholding
Contract breach: Buyer's claim for missing items
Removal disputes: Seller removes intended included items
Insurance gaps: Uninsured personal property loss

Common preparation mistakes to avoid

  • Using vague descriptions such as 'all appliances' instead of listing make, model, and serial numbers encourages post‑closing disputes.
  • Failing to state condition or warranties creates uncertainty about repair or replacement responsibilities after possession transfers.
  • Not specifying whether items are fixtures or removable personal property can lead to divergent legal interpretations at closing.
  • Skipping signatures, dates, or clearly attributed signer names undermines enforceability and complicates title and tax records.

Digital signing and file requirements for online completion

When completing the list electronically, set up authentication, audit trails, and file format options to preserve legal validity.

  • Authentication: Email + SMS code
  • File formats: PDF or DOCX
  • Integrations: Salesforce, NetSuite, Google Workspace

Platforms that capture a tamper-evident PDF and an audit trail complying with ESIGN and UETA help demonstrate intent, attribution, and retention for the executed document.
