Scope, Responsibilities & Warranty

Scope of Work: Seller/Builder shall supply selected paint materials and coordinate application in accordance with the room-by-room selections above. Paint application shall include surface preparation limited to typical patching and sanding; extensive repairs beyond standard preparation shall be quoted separately and require Buyer approval prior to work.

Responsibility for Workmanship and Materials: Seller/Builder warrants that materials supplied will be as specified herein and that workmanship will be performed in a professional manner. Manufacturer warranties, if any, are passed through to Buyer to the extent assignable. Seller/Builder makes no other express warranties.

Change Orders: Any change to color, finish, scope, or allowance shall be made in writing and signed by both parties. Written change orders shall set forth adjustments to schedule and payment. Verbal change requests are not binding until reduced to writing and signed.

Payment, Default and Remedies

Payment Terms: Paint allowance shall be applied at closing or per the payment schedule of the governing purchase agreement. Any costs exceeding the allowance shall be paid by the party indicated in the Overages Payable By selection above. Seller/Builder may elect to suspend work for nonpayment after ten (10) days' written notice.

Default and Remedies: Breach of this Paint Selection by either party shall be subject to the default, cure and remedy provisions of the related purchase agreement. In the absence of specific provisions there, the non-breaching party shall be entitled to seek specific performance, damages, or other relief as provided by law.

Miscellaneous Provisions

Integration: This Paint Selection constitutes the complete and final agreement regarding paint choices and allowances and is incorporated into and controlled by the underlying purchase agreement between Seller/Builder and Buyer, except to the extent inconsistent provisions are expressly stated herein.
