REAL ESTATE PARCEL DELIVERY ADDENDUM

If Tenant authorizes delivery to an alternate controlled area or requires gate or FOB access, Tenant must provide access instructions below and shall be solely responsible for any costs or damages related to providing such access.

Storage, Fees and Notification

Landlord may store accepted parcels in a secure location. Tenant shall retrieve parcels within days without charge. Thereafter, Landlord may charge a storage fee of $ per calendar day until retrieved.

Liability; Prohibited Items; Insurance

Landlord is not the carrier. Landlord's liability for loss, theft, damage, or mis-delivery of any parcel accepted under this Addendum is limited to $ per parcel, except for gross negligence or willful misconduct by Landlord.

Prohibited items that shall not be accepted, stored or delivered to the Property include hazardous materials, flammables, illegal goods, and items requiring specialized storage. Tenant affirms parcels will not contain such items.

Indemnification and Remedies

Tenant agrees to indemnify, defend and hold Landlord and its agents harmless from and against any loss, liability, claim, damage, cost or expense (including reasonable attorney fees) arising out of or related to acceptance, storage, handling or retrieval of parcels, except to the extent caused by Landlord's gross negligence or willful misconduct.

A breach of this Addendum constitutes a breach of the Lease/Agreement. In the event of default, the non-breaching party may pursue all remedies available at law or in equity, including termination of the Lease to the extent permitted by law.

This Addendum constitutes the entire agreement between the parties with respect to parcel delivery and supersedes prior oral or written statements on the subject.
