REAL ESTATE POOL AMENDMENT

This Pool Amendment ("Amendment") is made this Month Day Year , by and between Seller: and Buyer: .

RECITALS

A. Seller and Buyer are parties to a real estate purchase agreement (the "Agreement") executed on Month Day Year ; and B. The parties desire to amend the Agreement to address the existence, condition, repairs, compliance, and conveyance of a swimming pool, spa, associated equipment and safety devices on the Property described below.

PROPERTY IDENTIFICATION

AMENDMENT TERMS

1. Pool Present: The Property contains a pool or spa. Present: If "No" is selected, this Amendment applies only to obligations relating to future installation as expressly set forth herein.

2. Inspection; Report; Period. Buyer shall have a period of days from mutual execution of this Amendment to complete a pool and equipment inspection ("Inspection"). Buyer shall deliver any written inspection report to Seller within the Inspection period. Pool inspection report attached:

3. Repairs; Credits; Escrow Instructions. Seller agrees to complete the following repairs prior to Closing, at Seller's sole cost:

If Seller elects not to complete agreed repairs, Seller shall provide Buyer a monetary credit at Closing in the amount of to be applied to Buyer’s closing costs or as otherwise directed by Buyer in writing. Any repair escrow held by closing agent shall be released upon completion and final acceptance in writing by Buyer and Seller.

4. Permits and Code Compliance. Seller represents and warrants that, to Seller's actual knowledge, the pool, spa, and associated equipment are in material compliance with applicable laws, codes and permit requirements, except as noted below:

Seller shall, at Seller's expense, obtain any required permits and deliver copies of permits and final inspection approvals to Buyer prior to Closing. Seller warrants that any required pool barrier, gate, or alarm will be installed and operational at Closing unless otherwise agreed in writing.

5. Conveyance of Equipment. Seller agrees to convey the following pool equipment, accessories and manuals to Buyer at Closing (check all that apply) and list any additional items:

9. Insurance and Indemnity. From and after Closing, Buyer shall obtain and maintain liability insurance covering the pool and premises. To the extent permitted by law, Seller and Buyer agree to indemnify, defend and hold each other harmless from claims arising from their respective acts or omissions prior to transfer of possession.

10. Remedies for Failure to Comply. In the event Seller fails to perform obligations under this Amendment prior to Closing, Buyer may (a) accept an agreed credit, (b) require completion through escrow holdback, or (c) elect to terminate the Agreement and receive refund of Buyer’s deposit, as expressly provided in the Agreement. Remedies in this Amendment are cumulative and do not limit remedies in the Agreement.

11. Survival. The obligations and warranties contained in this Amendment shall survive Closing to the extent set forth herein and by applicable law.

12. Entire Agreement; Governing Law. This Amendment, together with the Agreement and any other documents expressly incorporated herein, constitutes the entire agreement between the parties with respect to the pool matters addressed herein. This Amendment shall be governed by and construed in accordance with the laws of the state in which the Property is located.
