Default, Remedies and Other Terms

Default: Tenant shall be in default for failure to pay rent within the grace period, material breach of lease terms, or failure to maintain required insurance. Upon default, Landlord may pursue remedies provided in the Lease and by law, including termination, recovery of possession, accelerated rent, and reasonable attorneys' fees and costs.

Holdover: Tenant who remains in possession after the Renewal Term without Landlord's written consent shall be subject to holdover tenancy at a rate equal to and shall be liable for damages.

Condition and Inspection: Tenant accepts the Property in its current condition unless noted in writing and signed by Landlord. Tenant may request a joint move-in/move-out inspection; arrangements must be made in writing.

Governing Law: This Renewal Offer and any resulting amendment to the Lease shall be governed by the laws of the state in which the Property is located.

Entire Agreement: Upon Tenant's acceptance, this Renewal Offer together with the existing Lease shall constitute the entire agreement between the parties with respect to the matters addressed herein and shall supersede any prior oral or written statements inconsistent with this Renewal Offer.
