What the Real Estate Representation Form Is

A Real Estate Representation Form documents the legal relationship between a client and a licensed real estate professional who will act on the client's behalf in buying, selling, leasing, or managing property. It sets the scope of authority, compensation, duties, term, and any exclusivity or dual-agency disclosures that affect negotiation and closing processes.

Why a Clear Representation Form Matters

A well-drafted Real Estate Representation Form allocates duties, reduces disputes about agency, clarifies commission terms, and creates an auditable record of consent and authority for use in negotiations and closings.

Why a Clear Representation Form Matters

Who Typically Completes This Form

Use the form whenever an agency relationship begins or when the parties change material terms such as compensation, exclusivity, or representation scope.

  • Licensed real estate agents representing buyers or sellers in transactions and negotiations.
  • Brokerage compliance officers maintaining agency records and commission agreements.
  • Individual clients or property owners establishing exclusive or non-exclusive agency relationships.

Essential Elements of a Professional Representation Form

A complete form covers parties, property description, scope of authority, compensation, term, disclosures, conflict-of-interest statements, termination rights, and signature blocks for all parties and witnesses or notaries when required.

Parties

Full legal names and entity status for all principals and licensed agents, with contact details and license numbers.

Scope

Clear description of services authorized (showings, offers, negotiations, disclosures, document execution) and any limits on authority.

Compensation

Commission or fee structure, payment timing, who pays, and handling of multiple-broker scenarios or splits.

Term

Start and end dates or event-based termination conditions and any automatic renewal language.

Disclosures

Dual agency, material facts, and statutory notices required by state law or broker policy; confirm receipt of disclosures.

Signatures

Signature blocks with typed names, dates, and notarization or witness sections if state law or the parties require them.

Step-by-Step: Filling Out the Form

Follow a consistent sequence: identify parties, describe property and services, set compensation, add disclosures, sign, then distribute copies to all parties and the brokerage.

  • 01
    1. Identify Parties: Enter full legal names and contact information.
  • 02
    2. Define Scope: Specify authorized activities and limits.
  • 03
    3. Confirm Compensation: Record commission or fee terms precisely.
  • 04
    4. Sign and Date: All required signers must sign and date the document.

Configuring an Online Completion Workflow

Map the digital workflow to the transaction: assign roles, set signature order, add required fields, and apply authentication to reduce fraud risk.

Field Configuration
Signer Order Specify primary signer then agent then brokerage
Required Fields Mark names, dates, and compensation as mandatory
Authentication Choose email link or SMS code per risk level
Notifications Enable reminders and completion receipts

Where the Completed Form Goes and Who Receives It

After signing, distribute copies to the client, agent, brokerage compliance file, and any escrow or title companies involved in the transaction.

  • Client Copy: Provide an executed copy to the client immediately
  • Brokerage File: Store in the broker compliance folder or CRM
  • Title/Escrow: Send to title or escrow for closing records
  • Accounting: Notify accounting for commission tracking

Digital Signing and Delivery Options

Ensure the chosen platform supports ESIGN/UETA compliance, audit trails, and any state-specific notarization or witness features required for closing.

  • Supported Formats: PDF, DOCX accepted
  • Authentication: Email link, SMS code, or stronger methods
  • Integrations: CRM and cloud storage connectors

Information Commonly Required on the Form

Client Name: Full legal name
Agent Name: License name and number
Property Address: Street, city, state, ZIP
Compensation: Commission percentage/fee
Effective Date: MM/DD/YYYY
Signatures: Signed and dated

Common Mistakes to Avoid

  • Using an informal or incomplete property description that creates ambiguity at closing and title review
  • Failing to include agent license number or brokerage name, which can breach state disclosure rules
  • Omitting the effective date or using inconsistent date formats across pages, creating disputes about timing
  • Relying on initials only where full signatures are required, causing acceptance issues with title or escrow

Consequences of an Incorrect or Missing Form

Commission Disputes: Loss of commission
Contract Voids: Contract may be unenforceable
Regulatory Fines: State licensing penalties
Closing Delays: Settlement postponement
Title Issues: Defects in chain of title
Civil Liability: Client claims or litigation

Timing and Typical Deadlines

Key timing rules depend on the transaction stage: sign representation forms at engagement, provide disclosures within state-mandated windows, and deliver executed copies promptly to all parties.

Upon Engagement:

Execute representation form at first formal engagement

Disclosure Window:

Provide required disclosures per state law, often immediately

Before Offers:

Confirm agency status prior to drafting offers

Prior to Closing:

Deliver final signed forms to title/escrow
