What the Real Estate Selection Document Is

A Real Estate Selection Document records a buyer's or tenant's formal choice among property options, units, or contract alternatives during a real estate transaction. It typically identifies the property, selection items (unit number, upgrades, parking, storage), monetary consideration or deposit, key contingencies, and signature blocks for all parties. When executed it clarifies intent, creates a trackable record for the transaction, and can be stored electronically or on paper. Electronic execution is generally enforceable under ESIGN and UETA when the four-part e-sign validity test is met.

Why a Selection Document Matters in Transactions

The document reduces ambiguity about which unit, options, or concessions the parties agreed to, speeds downstream processing, and preserves a written record that supports enforcement and closing.

Why a Selection Document Matters in Transactions

Who Typically Prepares and Signs This Document

Professionals across the transaction complete Real Estate Selection Documents to capture buyer or tenant choices and create a clear paper trail.

  • Buyers and tenants completing unit or option selections and confirming deposits and contingencies.
  • Listing agents and property managers preparing selection lists and attaching required disclosures.
  • Lenders, title companies, and closing agents using the document to verify selections before final documents are produced.

Knowing the typical participants clarifies responsibilities and prevents signature or authorization gaps during closing.

Core Elements Every Professional Selection Document Should Include

A well-structured form groups administrative data, economic terms, contingencies, and execution details so parties and downstream processors can validate selections quickly.

Property ID

Street address and unique unit identifier; include parcel number or MLS ID when available to avoid misidentification.

Selection Items

List discrete choices (unit/finish level/parking/storage/upgrades) with option codes and per-item pricing to make totals auditable.

Consideration

Specify deposit amount, allocation, refundable vs. nonrefundable status, and payment deadlines so financial obligations are clear.

Contingencies

Capture inspection, financing, appraisal, and HOA approval conditions with explicit cure periods and notice procedures.

Signatures

Designated signature blocks for buyer, seller, agent, and witness or notary fields as required by jurisdiction or lender.

Attachments

Exhibits for floor plans, finish schedules, disclosures, and price lists referenced by exhibit letter and date.

Information Usually Required on the Form

Setting Up an Online Selection Workflow

Configure the digital workflow so selections route to the right party, require appropriate authentication, and store a complete audit trail.

Where to Submit the Completed Selection Document

Routing depends on transaction structure; choose destinations that preserve compliance and support closing workflows.

  • Escrow or Title: Provide the document to escrow or title for incorporation into closing package.
  • Lender: Deliver selections to the lender if choices affect loan approval or appraisal valuations.

  • Integrations: Connects to CRMs and cloud storage
  • Authentication: Email, SMS, or advanced options

Typical Timelines and Deadlines to Track

Real estate selection workflows include specific deadlines for deposits, contingency expirations, and final selection cutoffs; track dates precisely to avoid forfeiture.

Contingency Expiration:

Last day to satisfy inspection or financing contingencies.

Final Configuration Cutoff:

Notarization and Witness Steps for Execution

Some jurisdictions or lenders require notarization or witnesses for certain real estate selection instruments; follow these steps when authentication is needed.

01

Prepare Originals

Gather unsigned originals and any ID required by the notary.

02

Sign In Presence

Signer must sign in front of notary or witness to validate execution.

03

Witness Attestation

Witness signs and provides printed name and contact information.

04

Notary Acknowledgement

Notary completes certificate, stamps, and dates the form.

05

Audio-Video RON

If using remote notarization, ensure identity-proofing and audio-video recording retention.

06

Record Journal

Notary logs session details and ID presented as required.

07

Return Originals

Return signed originals to escrow or the party designated for recordation.

08

Scan for Records

Create tamper-evident electronic copies for archival storage.

Risks and Potential Penalties from Errors

Invalid Execution: May void selections
Deposit Forfeiture: Missed deadlines risk loss of deposit
Backup Withholding: Incorrect TIN triggers 24% withholding
Recording Errors: Wrong property ID causes title issues
Regulatory Noncompliance: HIPAA or lending violations possible
Contract Disputes: Ambiguous selections increase litigation risk

Common Preparation Mistakes to Avoid

  • Using nicknames or initials instead of full legal names, which can slow identity verification and title review.
  • Failing to list option codes or prices clearly, creating ambiguity about what was included in the purchase price.
  • Missing signature or date fields, especially not completing notarization or witness steps required by state law.
  • Not routing completed selections to escrow, lender, or title promptly, causing closing delays and potential deposit disputes.

Practical Tips for Accurate and Efficient Completion

Apply these operational practices to reduce errors, speed verification, and make the document useful for closing and records.

Standardize Templates
Use a single approved template with conditional fields and labeled exhibits so all selections are recorded consistently and reviewers can reconcile totals easily.
Include Reference Codes
Add MLS or parcel numbers and option codes to every line item so title, escrow, and accounting teams can match selections to underlying records without manual follow-up.
Require ID Verification
For remote signings, implement email plus SMS or knowledge-based authentication to reduce fraud and meet lender or notary requirements.
Archive Audit Trails
Preserve timestamps, IP addresses, and version history so parties can reproduce the signing process in case of a dispute or regulatory review.
