Acknowledgment and Certification

Buyer acknowledges that selections and any approved upgrades described herein will be invoiced separately from the Purchase Agreement unless otherwise stated, and that Seller shall not commence installation of upgraded items until receipt of the required payment. Buyer further acknowledges that all selections are subject to availability and reasonable variance in color, texture, and dimension. Seller will provide credit or substitute only in accordance with the terms set forth in the Purchase Agreement or an executed change order.

Buyer agrees to pay all amounts due for selected upgrades as specified above. Failure to remit required payments by the Payment Due By date may constitute buyer default under the Purchase Agreement and may result in forfeiture of selection or assessment of late fees. Seller's warranties for selected items shall be limited to the manufacturer's warranty and any express warranty provided in the Purchase Agreement. This Selection Sheet supplements and does not supersede the Purchase Agreement unless expressly stated in writing and signed by both parties.

Remedies upon default: In the event of nonpayment for approved upgrades, Seller may suspend work, remove selected items from the contract, or invoice Buyer for costs incurred. Remedies available to either party for breach of this Selection Sheet are cumulative and in addition to remedies under the Purchase Agreement and at law or equity.

Governing Law: This Selection Sheet shall be governed by the laws of the state in which the Property is located. Entire Agreement: This Selection Sheet, together with the Purchase Agreement and any executed change orders, constitutes the entire agreement with respect to selections and upgrades and may be modified only by a written instrument signed by both Buyer and Seller.
