What the Real Estate Signed Agency establishes

A Real Estate Signed Agency is a written agreement that documents the relationship and authorities between a property owner and a licensed real estate agent or broker. It defines the scope of representation (listing, buyer agency, or property management), the agent's authority to act, the commission or fee structure, the contract term, and any required disclosures. When signed by the parties, the form creates enforceable duties and sets expectations for marketing, offers, and closing activities. Electronic signatures are generally acceptable under U.S. law when the parties meet e-signature legal tests.

Why a signed agency agreement matters

A written Real Estate Signed Agency clarifies who represents whom, reduces disputes about commission and authority, and documents mandatory disclosures under state law. Proper signatures and dates create a clear record of consent and timing, which matters for agency duties and timelines. ESIGN and UETA provide a legal framework for enforceable electronic signatures when the legal validity criteria are met.

Why a signed agency agreement matters

Typical parties who complete the Real Estate Signed Agency

The agreement is completed by the parties directly involved in the transaction and their authorized representatives.

  • Listing agents and their sponsoring broker — establish listing authority, marketing rights, and commission split.
  • Buyers and buyer's agents — set buyer representation, showings protocol, and compensation arrangements.
  • Property owners and managers — define property management scope, rent collection, and termination terms.

Copies should be retained by each party and the sponsoring broker for compliance, recordkeeping, and future reference.

Representative signer roles

Broker

Managing broker or sponsoring broker signs to accept responsibility for supervision and to acknowledge license compliance. The broker's signature typically binds the brokerage to commission and reporting obligations and is required on many forms under state real estate rules.

Client

Seller, landlord, or buyer signs to grant authority to the agent and to confirm compensation terms. The client's signature and date establish when agency duties and disclosures take effect and are central to resolving disputes over representation.

Core elements to include in every Real Estate Signed Agency

A professional Real Estate Signed Agency includes standard clauses to make the relationship clear and enforceable across jurisdictions.

Parties

Full legal names and contact details for the client and the broker or agent, including brokerage name and license numbers where required.

Property

A clear description of the property or property types covered by the agreement, with addresses or legal descriptions to avoid ambiguity.

Scope of Authority

Specific authorities granted to the agent, such as marketing, negotiating offers, accepting deposits, or signing closing documents on behalf of the client.

Term

Effective date and termination date or event, including automatic renewal terms if any, and conditions for early termination.

Compensation

Commission percentage or flat fee, how it is calculated, when it is earned, and who is responsible for paying it if multiple brokers are involved.

Disclosures

State-required agency disclosure language, conflict-of-interest statements, and acknowledgment of any material facts the client must provide.

Common mistakes when preparing a Real Estate Signed Agency

  • Using informal language for commission terms, which creates ambiguity about entitlement and timing of payment.
  • Failing to include agent license or brokerage identification, leading to compliance issues with state regulators.
  • Submitting unsigned or partially signed agreements; missing a required signature can void the agency relationship.
  • Not preserving the audit trail for the e-signing event, causing difficulties proving consent and intent later.

Consequences of errors in the agency agreement

Invalid signature: May render agreement unenforceable
License omission: State sanctions or fines possible
Commission dispute: Risk of litigation or arbitration
Disclosure failure: Regulatory penalties and rescission risk
Recordkeeping lapse: Compliance violations and fines
TIN mismatch: Backup withholding triggers

License proof

Keep a copy of the agent's active license and brokerage details in the broker file for regulatory audits.
