What the Real Estate Super 8 Agreement Covers

The Real Estate Super 8 Agreement is a standardized transactional contract used in residential and commercial real estate to record core deal terms—parties, property, price, deposit, closing timeline and key contingencies—in a concise, eight-section format. It functions as a binding agreement when fully executed by authorized signers and can be used as a primary purchase/lease contract or as an addendum to longer documents. When executed electronically, the agreement should meet ESIGN and applicable state UETA/ESRA requirements to ensure enforceability and retain a full audit trail for attribution, consent, and record reproduction.

Why a Compact Super 8 Format Is Useful

The Super 8 layout simplifies negotiation and speeds execution by focusing on essential deal points while preserving legal clarity. For electronic use, confirm intent, consent, attribution and retention per the ESIGN Act (15 U.S.C. ch. 96) and applicable state UETA or ESRA rules to maintain enforceability.

Why a Compact Super 8 Format Is Useful

Who Typically Prepares and Signs the Super 8 Agreement

Typical participants include brokers, listing agents, buyers, sellers, property managers and counsel; internal legal or contract teams may prepare clause language before execution.

  • Real estate brokers and agents — draft core deal terms and coordinate signatures during listing and offer stages.
  • Buyers and sellers — review economic terms, contingencies, and closing timelines before signing.
  • Attorneys and title agents — verify legal descriptions, contingency language, and deed/notarization requirements.

The form is designed for use by parties seeking a clear, short-form contract; involve counsel for complex title, financing, or regulatory issues.

Step-by-Step: Completing a Super 8 Agreement

Follow a simple sequence to prepare, review, and execute the agreement reliably.

  • 01
Draft Core Terms: Populate parties, property, price, deposit, dates and contingencies.
  • 02
Review and Approve: Have counsel or title agent confirm legal description and closing conditions.
  • 03
Authenticate Parties: Confirm signer identity and authority to sign for entities.
  • 04
Execute and Distribute: Obtain signatures, save copies, and route executed originals to escrow and counsel.
